Magetan KPU Clarifies Votes in Kinandang and Nguri Villages

JAKARTA (MKRI) – The Court held an examination hearing for the Respondent, the Relevant Party, and Bawaslu on the 2024 Magetan Regency election results dispute on Friday, January 17, 2025. It was presided over by Chief Justice Suhartoyo (panel chair) and Constitutional Justice Foekh and M. Guntur Hamzah on panel 1.

The Magetan Regency KPU (Elections Commission), represented by Puji Muhamad Ridwan, addressed the concerns regarding three problematic polling stations. Candidate Pair 03 Sujatno–Ida Yuhana Ulfa (Petitioners) alleged that many voters were absent and that votes were cast by other parties using the identities of deceased individuals or those who were out of town. According to the C-Result-KWK Form from TPS 1 Kinandang Village, Bendo District, there were 555 people listed, with a DPT (final voter list) of 1 person, and the actual number of voters was 552, or 99.28%.

“Therefore, there was nothing unusual, strange, or impossible, as claimed by the Petitioners. This demonstrates that the organizing committee succeeded in boosting public participation in exercising their voting rights,” said Puji during the hearing for Case No. 30/PHP.BUP-XXIII/2025.

The Respondent further clarified that, based on the C-Result-KWK Form from TPS (polling station) 004 Jinandang Village, Bendo District, and TPS 001 Nguri Village, Lembeyan District, the same findings were recorded. In essence, there was nothing impossible regarding the number of voters or the use of voting rights, contrary to the claims made by the Petitioners.

Deny Allegation of Deceased Voters

Meanwhile, the Relevant Party’s legal counsel Regginaldo Sultan denied the Petitioner’s claim regarding a voter named Sarmi, who argued had passed away but was still listed in the DPT (final voter lists) for TPS 1 in Kinandang Village, Bendo District.

“There are two individuals named Sarmi. We have obtained evidence from the village government confirming that both individuals are still alive. A certificate from the village government states that these people listed in the DPT, with different addresses, are both alive,” confirmed Regginaldo.

During the preliminary hearing on Wednesday, January 8, 2025, the Petitioners challenged the anomalous validity of the vote count discrepancies at two polling stations (TPS) in Kinandang Village, Bendo District, and one TPS in Nguri Village, Lembeyan District. Consequently, the Petitioners requested the Constitutional Court to annul the Magetan Regency KPU Decree No. 1676 of 2024 concerning the certification of the 2024 Magetan Regency election results, dated December 3, 2024.

The Petitioners stated that the vote count results by the Magetan Regency KPU, their vote acquisition was 136,083 votes, Candidate Pair 01 Nanik Endang–Suyatni Priasmoro received 137,347 votes, and Candidate Pair 02 Hergunadi–A. Basuki received 131,264 votes. However, they argued that the votes for Candidate Pair 01 were obtained through violations of the principles of direct, public, free, confidential, honest, and fair elections.

In addition, the Petitioners argued that the KPPS (polling station working committee) had committed violations at TPS 001 and TPS 04 of Kinandang Village in Bendo District and TPS 001 of Nguri Village in Lembeyen District. At these polling stations, the KPPS did not accurately check the voter data. As a result, the voter data were misused by other people who were not eligible, and there could potentially be double voters.
