JAKARTA (MKRI) The 2024 Magetan Regency Candidate Pair 03 Sujatno-Ida Yuhana Ulfa filed a petition concerning the validity of the unusual vote margin at two polling stations (TPS) in Kinandang Village in Bendo District and at one polling station in Nguri Village of Lembeyan District. Therefore, they requested the Court to annul the Magetan Regency KPU (Elections Commission) Decree No. 1676 of 2024 on the results of the 2024 election of Magetan regent-vice regent dated December 3, 2024. The preliminary hearing was presided over by Chief Justice Suhartoyo (panel chair) and Constitutional Justices Foekh and M. Guntur Hamzah on panel 1 on Wednesday, January 8, 2025.

At the hearing for Case Number 30/PHP.BUP-XXIII/2025, Wakit Nurohman as the Petitioners’ legal counsel outlined the petition’s arguments, which are based on the certification of the vote count results by the Magetan Regency KPU, in which the Petitioners earned 136,083 votes, while Candidate Pair 01 Nanik Endang-Suyatni Priasmoro earned 137,347 votes, and Candidate Pair 02 Hergunadi-A. Basuki earned 131,264 votes. However, Candidate Pair 01 allegedly obtained votes by violating the principles of free and fair elections.

Wakit added that at TPS 1 and TPS 4 of Kinandang Village in Bendo District with 99.4% voter turnout, 98.48% or 410 voters chose Candidate Pair 01, while only 127 voters voted for the Petitioners. Compared to the voters’ attendance and the Petitioners’ electability in these two districts and other districts in Magetan Regency, such results were unreasonable. This comparison can be seen in the attendance list at two polling stations were voter turnout was only 86% and 99%. Therefore, based on these legal facts, the Petitioners believe that the validity of the vote acquisition at the polling stations cannot be guaranteed and have violated the principle of fair elections as mandated by Article 22E paragraph (1) of the 1945 Constitution.

In addition, the Petitioners argued that violations had been committed by the KPPS (polling station working committee) at TPS 001 and TPS 04 of Kinandang Village in Bendo District and TPS 001 of Nguri Village in Lembeyen District. At these polling stations, the KPPS did not accurately check the voter data. As a result, the voter data were misused by other people who are not eligible and there could potentially be double voters.

“The Petitioners requests the Court to annul the Decree of the Magetan Regency Elections Commission No. 1676 of 2024 concerning the results of the 2024 regent-vice regent election of Magetan Regency dated December 3, 2024 on the vote acquisition of Candidate Pair 01 Nanik Endang-Suyatni Priasmoro; to certify Candidate Pair 03 Sujatno-Ida Yuhana Ulfa with 136,083 votes as winners of the 2024 Magetan regent-vice regent election; to order a revote at TPS 001 and TPS 004 of Kinandang Village of Bendo District and TPS 001 of Nguri Village of Lembeyen District in Magetan Regency,” said Beny Wahyudi reading the petitums in the plenary courtroom.
