Court Grants Ali Mazi’s Petition Withdrawal Request

JAKARTA (MKRI) — The Constitutional Court (MK) approves the withdrawal of the 2024 DPR-DPRD (House of Representatives-Regional Legislative Council) election results dispute petition for case No. 11-02-05-28/PHPU.DPR-DPRD-XXII/2024 on Friday, June 7, 2024. The case was petitioned by Ali Mazi, a DPRD candidate for the National Democratic Party (Nasdem).

“[The Court] grants the Petitioner’s request to withdraw the petition; declares the petition for case No. 11-02-05-28/PHPU.DPR-DPRD-XXII/2024 dated March 23, 2024 regarding the annulment of the General Elections Commission (KPU) Decree No. 360 of 2024 on the certification of the results of the 2024 DPR (House of Representatives), DPD (Regional Representatives Council), and Provincial and Regency/City DPRD (Regional Legislative Council) election as it pertains to the vote acquisition of the DPRD candidates for Southeast Sulawesi Province withdrawn,” stated Chief Justice Suhartoyo at the ruling hearing.

In its legal considerations, the Court revealed that at the justice deliberation meeting on June 3, 2024 it had concluded that the request for the case’s withdrawal was legally warranted and the Petitioner cannot refile the same petition. The Court ordered the chief registrar to return copies of the case files to the Petitioner.

Therefore, based on legal considerations, the Court decided not to further consider the Respondent’s answer, Bawaslu’s (Elections Supervisory Body) statement, or the written evidence and witnesses’ testimonies for the Respondent, deeming them irrelevant.

The Petitioner’s had previously argued that the Respondent had made an error in the vote counting. He also argued that there were additional votes at the recapitulation plenary meeting at Wangi-Wangi Selatan polling station and there were discrepancies with the C-result form at the Wangi-Wangi Selatan polling station.

At the evidentiary hearing on Monday, June 3, 2024 in the plenary courtroom, Ali Mazi (Petitioner) through legal counsel Dedy Ramanta announced the petition’s withdrawal.
