JAKARTA (MKRI) — The legislative Candidate of the House of Representatives (DPR), Ali Mazi, from the National Democratic Party (NasDem) filed the petition for general election results dispute (PHPU) to the court. The petition No. 11-02-05-28/PHPU.DPR-DPRD-XXII/2024 concerning a filling internal position of the DPR electoral district of Southeast Sulawesi.
The court presided over by Chief Justice Suhartoyo, The Petitioner represented by Heriyanto Citra Buana, said that DPR member candidate number 1 Ali Mazi (Petitioner) received 68,093 votes, while candidate number 2 Tina Nur Alam's votes were only 67,538 votes.
"However, after the votes recapitulation in Wangi-Wangi Selatan subdistrict, Ali Mazi's vote acquisition became 68,099 votes and Tina Nur Alam experienced a very significant increase in vote acquisition by 1,100 votes, bringing Tina Nur Alam's total vote acquisition to 68,683 votes," Heriyanto Stressed.
In his petition, the Petitioner stated a discrepancy in the C. Results data in 64 polling stations at Wangi-Wangi Selatan subdistrict in the Plenary Recapitulation of National Vote Counting Results. The session's chairperson (Chair of KPU) asked to be written in the witness objection form and submitted to the Elections Supervisory Body (Bawaslu) to handle election violations.
Bawaslu's decision will be made to correct the vote tally. Based on that, Dedy Ramanta, a witness for the NasDem Party, submitted a report on alleged administrative violations to Bawaslu.
Furthermore, the case was decided by Bawaslu which confirmed that there had been an addition/inflating of the votes for candidate for DPR RI member Tina Nur Alam by 1,100 votes. In this decision, the General Elections Commission (KPU) declared that it had legally and convincingly committed an administrative violation and was given a warning sanction not to repeat the violation. Bawaslu should have ordered the Indonesian KPU to make corrections to the inflated votes, but according to Bawaslu's Decree Number 290/PP.00.00/K1/03/2024, the implementation of corrections to party and candidate vote tallies after determining the election results was handed over to the Court.
For this reason, in his petitum, the Petitioner asked the Court to annul General Election Commission Decree Number 360 of 2024 throughout the Southeast Sulawesi Electoral District to fill in candidates for DPR members from the NasDem Party. As well as asking the Court to order the KPU to determine the vote tally of parties and candidates for members of the DPR RI NasDem Party for the Southeast Sulawesi Electoral District according to the Petitioner's calculations.
