JAKARTA (MKRI) — The Constitutional Court held a follow-up hearing on the 2024 election results dispute (PHPU) on Tuesday, May 28, 2024 on Panel where it asked the Petitioner’s legal counsel for confirmation of a letter from the Aceh Party questioning why case No. 144-01-21-01/PHPU.DPR-DPRD-XXII/2024 was still examined, despite a letter of petition withdrawal.
The hearing was presided over by Constitutional Justices Arief Hidayat (panel chair), Anwar Usman, and Enny Nurbaningsih. The case was filed by the Aceh Party, represented by chairman Muzakir Manaf and secretary-general Kamaruddin Abubakar regarding the election of the North Aceh DPRD in the electoral district of North Aceh 5.
At the previous hearing on Monday, May 3, Muzakir Manaf and Kamaruddin Abubakar withdrew their petition. However, legal counsel Muntasir stated that the withdrawal was false because the signature of the Aceh Party’s secretary-general was forged.
Constitutional Justice Arief Hidayat said that this matter will be reported to the justice deliberation meeting (RPH) and the litigating parties would be summoned in the next 1-2 days to decide whether this case will be followed up or decided to be inadmissible.
“[The Court] will immediately report it in the justice deliberation meeting of all nine justices. In the next 1-2 days, we will summon the parties,” he said.

In its petition, the Petitioner argued that there was a margin between the correct vote according to the Petitioner and that which was determined by the General Elections Commission (KPU). The Petitioner claimed there were additional invalid votes for the Aceh Party legislative candidate number 2 for North Aceh 5 Abdul Muthaleb at the recapitulation at in Syamtalira Aron and Tanah Pasir Subdistricts. The addition of these votes caused Abdul Muthaleb’s total votes to increase from 2,924 (according to the C-result plano form and the C-result copy) to 3,887 in North Aceh 5, as stated in the DPRK subdistrict D-result form and the regency/city DPRK D-result form.
