JAKARTA, MKRI – The Constitutional Court held a preliminary hearing on the General Election Results Dispute (PHPU) of the the North Aceh Regency/City Legislative Council (DPRK) in the North Aceh electoral district (Dapil) 5 for Case Number 144-01-21-01/PHPU.DPR-DPRD-XXII/2024 in Panel 3 MK Courtroom, on Tuesday morning, April 30, 2024. The petitioner in this case was the Aceh Party, represented by Muzakir Manaf as General Chairman of the Aceh Party and Kamaruddin Abubakar as General Secretary of the Aceh Party. Erizon S. Chaniago as the legal counsel argued on the difference between the correct vote according to the Petitioner and the one determined by the Respondent (General Election Commission).

According to the petitioner, the addition of votes was carried out by shifting the votes of other parties and Aceh Party Candidates to candidate number 2 Abdul Muthaleb in Syamtalira Aron and Tanah Pasir Districts by 963 votes. There were additional invalid votes for the Aceh Party Legislative Candidate for North Aceh 5, No. 2, Abdul Muthaleb during the recapitulation at the Syamtalita Aron and Tanah Pasir Sub-district levels.

The addition of these votes caused Abdul Muthaleb's total votes increased from 2,924 votes (according to the C.Plano Results and C.Copy Results) to 3,887 votes in electoral district (Dapil) 5, as stated in the D. DPRK Sub-district Results and D. DPRK Kabko Results.

On the basis of the arguments presented, the petitioner asked the Court to grant all of the petitioner’s requests, cancel the General Election Commission Decision number 360 of 2024, and determine the results of the vote acquisition in accordance with the petition considered correct.
