JAKARTA (MKRI) — The Constitutional Court (MK) dismissed the petition by Elyas Yohanis Asamau, a Regional Representative Council (DPD) candidate for East Nusa Tenggara Province, on Wednesday, May 22, 2024. The ruling hearing for Case No. 02-19/PHPU.DPD-XXII/2024 on the 2024 election results dispute for members of the DPR (House of Representative), DPD (Regional Representatives Council), and Provincial and Regency/City DPRD (Regional Legislative Council) was held in the plenary courtroom.

After comprehensively reading the petition, particularly the petitum, Constitutional Justice Arsul Sani said, out of the 29 claimed polling stations (TPS), 24 were not detailed in the posita. The Petitioner requested a recount or revote at 203 polling stations in Alak Subdistrict, Kupang City, but the Court found only 32 polling stations there. Additionally, no details were provided for the 29 polling stations in Boking Subdistrict, South Central Timor Regency.

“[The Court] adjudicated, relating to exceptions: to reject the Respondent’s exception concerning the Court’s jurisdiction; relating to the subject matter: to declare the Petitioner’s petition inadmissible,” said Suhartoyo, reading out the decree for the case.

The Petitioner noted a 90-vote discrepancy in Kupang City, where the Respondent reported 25,194 votes while the Petitioner 25,104 votes. Hilda Manafe’s (DPD Candidate No. 7) vote count in the Respondent’s version was 39,233 votes, while in the Petitioner’s version 39,153 votes, with a difference of 80 votes. The Petitioner claimed the Respondent gave this candidate valid votes. The Petitioner alleged that the Respondent’s data showed 265,900 votes for the Petitioner and 267,195 votes for Candidate No. 7 across all regencies/cities in East Nusa Tenggara Province, with a difference of 1,295 votes. Therefore, the Petitioner’s correct vote count would make him an East Nusa Tenggara DPD member-elect.

The Petitioner asked the Court to annul the General Elections Commission (KPU) Decree No. 360 of 2024 for election results from five Southwest Sumba Regency polling stations: TPS 03 in Tara Mata Village, TPS 02 in Bondo Uka Village, TPS 05 in Mata Lombu Village of Central Wewewa Subdistrict), as well as TPS 03 in Maliti Daru Village in East Wewewa Subdistrict, and TPS 004 Bolora Village in Central Wewewa Subdistrict.
