NTT DPD Candidate Questions on Vote Transfer

JAKARTA (MKRI) — Elyas Yohanis Asamau, a candidate for the Regional Representative Council (DPD) from the electoral district of East Nusa Tenggara filed a petition on 2024 Legislative Election Results Dispute for DPD Members (PHPU DPD) for 2024 to the Constitutional Court. The hearing for Case No 02-19/PHPU.DPD-XXII/2024 was conducted by Panel 2, presided over by Deputy Chief Justice Saldi Isra, along with Constitutional Justices Ridwan Mansyur and Arsul Sani, on Thursday, May 2, 2024.
Legal counsel Ferdinandus Maktaen stated that there is a discrepancy in the vote tally for the Petitioner, specifically in Kupang City, where the Respondent recorded 25,194 votes for the Petitioner and the Petitioner claimed 25,104 votes, resulting in a margin of 90 votes. Meanwhile, Hilda Manafe (DPD candidate number 7) received 39,233 votes according to the Respondent and 39,153 votes according to the Petitioner, resulting in a margin of 80 votes. Ferdy continued, this occurred because the Respondent added valid votes for the said candidate. Furthermore, from the comparison of the Petitioner's vote tally across all regencies/cities in NTT Province, Ferdi noted that according to the Respondent, the Petitioner received 265,900 votes and candidate number 7 received 267,195 votes, resulting in a margin of 1,295 votes. Based on this comparison, the accurate vote tally would actually place the Petitioner as the elected candidate for the DPD RI from the NTT electoral district.
"The Petitioner requests that the Court issue a ruling to thoroughly annul the General Elections Commission (KPU) Decision No. 360 of 2024 concerning the Certification of Election Results for the President and Vice President, Members of the House of Representatives, the Regional Representatives Council, the Provincial Legislative Council, and the Regency/City Legislative Councils nationally, announced on Wednesday, March 20, 2024, specifically relating to occurrences at five polling stations in Southwest Sumba Regency as follows: Polling Station 03 in Tara Mata Village, Polling Station 02 in Bondo Uka Village, Polling Station 05 in Mata Lombu Village in Central Wewewa Subdistrict; Polling Station 03 in Maliti Daru Village, Eastern Wewewa Subdistrict; and Polling Station 004 in Bolora Village, Central Wewewa Subdistrict," stated Ferdi.
