JAKARTA (MKRI) — In Decree No. 223-01-04-15/PHPU.DPR-DPRD-XXII/2024, the Constitutional Court (MK) declared that the petition filed by the Party of Functional Groups (Golkar) was inadmissible. The ruling hearing for the 2024 election results of the DPR (House of Representatives) and Provincial and Regency/City DPRD (Regional Legislative Council) took place on Wednesday, May 22, 2024.

Deputy Chief Justice Saldi Isra read out the Court’s legal considerations, mentioning two unusual petitums. On the one hand, the Court was asked to determine the party’s votes. On the other hand, it was asked to determine the individual votes for Golkar candidates at 24 polling stations. Based on reasonable reasoning, the Court could not possibly grant the petitums unless they were requested as alternatives and not cumulatives. Such opposing petitums have made the petition unclear or vague.

“[The Court] adjudicated, relating to the exceptions: to reject the Relevant Party’s exception; relating to the subject matter: to declare the Petitioner’s petition inadmissible,” said Chief Justice Suhartoyo in the plenary courtroom.

At the preliminary hearing, the Petitioner compared the votes for the reduction of votes in Klampis, Sepulu, and Geger Subdistrict, which reached 2,299 votes. There was an increase in votes for other parties such as the National Awakening Party (PKB) by 646 votes, the National Democratic Party (NasDem) by 114 votes, PKS by 33 votes, the National Mandate Party (PAN) by 975 votes, the Democratic Party by 32 votes, and the United Development Party (PPP) by 499 votes. In addition, the Petitioner also argued Golkar’s votes had been reduced in 6 villages: Bator, Bragang, Panyaksagan, Larangan Glintong, East Klampis, and Manonggal. It also argued that there was a transfer of votes totaling 64 votes: 19 votes to PPP DPRD candidate; 21 votes to PKB DPRD candidate; 7 votes to NasDem candidate; 8 votes to the Democratic Party DPRD candidate, and 9 votes to Hanura DPRD candidate.
