Past Deadline, Democratic Party Candidate’s Petition Dismissed

JAKARTA (MKRI) — The Constitutional Court (MK) declared that case No. 253-02-14-37/PHPU.DPR-DPRD-XXII/2024 on the 2024 legislative election results dispute (PHPU) for Papua Pegunungan Province inadmissible. This case was filed by DPRD (Regional Legislative Council) candidate Wali Wonda number 4 from Democratic Party for the electoral district of Papua Pegunungan Province 4.

“[The Court] adjudicated, relating to the petition’s subject matter: to rule that the Petitioner’s petition is inadmissible,” said Chief Justice Suhartoyo alongside the other eight constitutional justices at a ruling hearing in the plenary courtroom on Wednesday, May 22, 2024.

Suhartoyo stated that the Petitioner’s petition did not fulfill the formal requirements of the petition as referred to in Article 74 paragraph (3) of the Constitutional Court Law, Article 474 paragraph (2) of the Election Law, and Article 7 paragraph (1) of Constitutional Court Regulation No. 2 of 2023. As such, the Respondent’s and Relevant Party’s exceptions on the petition being past deadline were legally warranted. Thus, the Court stated that the Petitioner’s petition has passed the deadline set by the laws and regulations.

Although the Court had the authority to hear the a quo petition, because the Petition was filed past deadline, the Respondent’s answer, the statement and exception of the Relevant Party, the statement of Bawaslu (Elections Supervisory Body), the Petitioner’s legal standing, and the subject matter of the petition, as well as other matters were not considered further because they were deemed irrelevant.

The Respondent announced the General Elections Commission (KPU) Decree No. 360 of 2024 dated 22:19 WIB of March 20, 2024. The deadline for filing election disputes was 3x24 hours from the announcement, or March 23, 2024 at 22:19 WIB. Meanwhile, the Petitioner filed the petition to the Court on April 22, 2024 at 13:15 WIB.

Previously, in Petitioner’s petition, he argued that there was a reduction in his votes and the addition of votes for fellow Democratic Party candidates, so that Wali Wonda failed to get a seat in the Papua Pegunungan Province DPRD. He claimed that his vote count was 9,309 and that he was ranked second. A total of 4,283 votes were not counted and included in the copy of C-DPRPP form. The total number of Wali Wonda’s valid votes from seven districts in the electoral district of Papua Pegunungan 4 amounted to 13,592 votes.
