JAKARTA (MKRI) — The Constitutional Court (MK) dismissed a 2024 DPRD (Regional Legislative Council) election results dispute petition for the electoral district of Tolikara 1 of Papua Pegunungan Province on Wednesday, May 22, 2024 in the plenary courtroom. The case No. 108-02-14-37/PHPU.DPR-DPRD-XXII/2024 was filed by Orgenes Wanimbo from the Democratic Party.
“[The Court] adjudicated, relating to the petition’s subject matter: to rule that the Petitioner’s petition is inadmissible,” said Chief Justice Suhartoyo alongside the other eight constitutional justices.
In its legal considerations, delivered by Justice M. Guntur Hamzah, the Court asserted that the Petitioner’s petition did not fulfill the formal requirements of the petition as referred to in Article 74 paragraph (3) of the Constitutional Court Law, Article 474 paragraph (2) of the Election Law, and Article 7 paragraph (1) of Constitutional Court Regulation No. 2 of 2023. Therefore, the Respondent’s and the Relevant Party’s exceptions regarding the Petitioner’s petition passing deadline were legally warranted. Thus, the Court asserted that the Petitioner’s petition had been filed past the deadline specified by the laws and regulations.
Although the Court had the authority to adjudicate the petition, because the petition was filed past the deadline determined by the legislation, the Respondent’s answer, the statement and exceptions of the Relevant Party, the statement by Bawaslu (Elections Supervisory Body), the Petitioner legal standing, and the subject matter of the petition, as well as other matters were not considered further because they were deemed irrelevant.

Previously, the Petitioner argued that he had lost 10,507 votes because they were purged by the chairman and members of the district election committee (PPD) of Biuk, Karubaga, and Nelawi. He alleged that his votes were transferred to four candidates from PKS (Prosperous Justice Party), PDI-P (Indonesian Democratic Party of Struggle), PBB (Crescent Star Party), and PKB (National Awakening Party).
In his petitum, the Petitioner asked the Court to cancel the KPU (General Elections Commission) Decree No. 360 of 2024 as it pertains to the electoral district of the Tolikara 1 for the Tolikara Regency DPRD election for Democratic Party candidate number 1.
