PKB Petition in East Java dismissed Due to Lack of Evidence

JAKARTA, MKRI – The Constitutional Court (MK) rules that Case No. 237-01-01-15/PHPU.DPR-DPRD-XXII/2024 filed by the National Awakening Party (PKB) for a Election Results Dispute (PHPU) in East Java Province is obscure. According to the Court, the Petitioner did not submit physical evidence until the specified time limit during the improvement period.

“[The Court] rules to declare the Petitioner’s petition inadmissible,” said Chief Justice Suhartoyo in the plenary courtroom. At Plenary Courtroom, building 1 on Wednesday, May 22, 2024.

In consideration of the Constitutional Justice Arsul Sani explained, the Petitioner did not complete the Petitioner’s with physical evidence until the final deadline. The Petitioner only submitted the physical evidence during the preliminary examination session on April 29, 2024.

“[The Court] adjudicated, relating to the petition’s subject matter, to rule that the Petitioner’s petition is inadmissible as specified in Article 9 paragraph (2) of Constitutional Court Regulation (PMK) No. 2 of 2023 so that the petition has been rejected of the quo petition,”  said Arsul.

At the Preliminary Session, the Petitioner described the difference in vote acquisition with the addition of the Democratic Party's votes in Socah Subdistrict, Petonan Village TPS 005 as many as 170 votes. Also the Hanura Party in Socah Sub-district, Parseh Village. The Petitioner said that the vote inflation occurred due to data input errors from the Respondent (KPU). The Petitioner said that the PKB witness had objected through the Special Event D.form, but a copy of the objection was not given by the Socah District PPK. but the PKB witness forgot about the objection so he signed the D.Results of Bangkalan District 1.
