KPU Denies Allegations of Additional Democratic Party Votes in Bangkalan 1

JAKARTA (MKRI) — The General Election Commission (KPU) has denied the argument of the National Awakening Party (PKB) that there were additional votes for the Democratic Party in 3 polling stations in Petaonan Village, Socah Subdistrict, Bangkalan Regency by 500 votes. The argument was revealed in the continued hearing of the Dispute over the General Election Results for Members of the DPR RI, Provincial DPRD, Regency / City DPRD in 2024 (PHPU DPR / DPRD) in the Panel Courtroom, Building 2 of the Constitutional Court on Monday (6/5/2024). The second hearing of the PKB (Petitioner) petition was held to hear the answers of the KPU (Respondent) and Relevant Parties as well as Bawaslu's testimony. The hearing was carried out by Panel 2 presided over by Deputy Chief Justice Saldi Isra (panel chair) with the Constitutional Justices Ridwan Mansyur and Arsul Sani.

The legal counsel of the KPU, M. Faiz Putra Syanel, stated that after comparing the data using the D.Results at the Socah District level, it can be concluded that there is no difference between the C.Results and D.Results at the sub-district level. The difference argued by the Petitioner is incorrect in using the object to perform the calculation, namely the C.Results Copy which is different from the C.Results Copy issued by the Respondent. Thus, the Petitioner was not at all aggrieved by the results of the recapitulation at the polling station level up to Socah Sub-district.

Then Faiz also answered the Petitioner's argument on the addition of 700 votes to the Democratic Party in 10 polling stations in Socah Subdistrict, Parseh Village. "Similar to the first argument, the Respondent after comparing with the C.Results of TPS and D.Results at the Parseh District level, there are no differences in results as stated by the Petitioner," said Faiz on the petition for Case No. 237-01-01-15/PHPU.DPR-DPRD-XXII/2024.

No Evidence

While the Hanura Party's legal counsel, M. Ainul Syamsu said that there were no additional votes from other political parties in the voting in Paseh Village. Based on the evidence of Model C. Results of DPRD / City, Model C. Results of District / City DRPD Copies, and Appendix Model D. District Results-DPRD Kabko, the Relevant Party obtained 700 votes, so that the overall vote acquisition of the Relevant Party was 8,715 votes.

"This is the one contained in the Bangkalan KPU Decree No. 869 of 2024 on the Stipulation of the General Election Results for the Bangkalan Regency Regional DPR in 2024, which showed the same acquisition figures," said Ainul.

Furthermore, Nadya Prita from the legal counsel of the Democratic Party, who also acted as the Relevant Party, said that there was no truth in the addition of 1,200 votes which indicated the manipulation of the D.Results of Sub-District-DPRD KABKO and C.Results of regency/city documents. In addition, the Petitioner could not show the intended vote counting error.

PKB Witnesses are Attended

The Election Supervisory Body (Bawaslu) of East Java Province through A. Warits explained the Petitioner's argument that the PKB witness in Socah Sub-district had objected through a Special Event, however, a copy of the objection was not given by the Sub-district Subdistrict Election Committee (PPK). Based on Panwascam's observation, the witness from PKB on behalf of Abd. Manab was present during the recapitulation at the sub-district level. The witness did not even file an objection through the Special Occurrence Model D form.

At the Preliminary Hearing, the Petitioner described the difference in vote acquisition with the addition of Democratic Party votes in Socah Subdistrict, Petonan Village TPS 005 with 170 votes. Then there were also additional Hanura Party votes in Socahah Sub-district, Parseh Village. The Petitioner said that the inflation of these votes was due to data input errors from the Respondent (KPU). The Petitioner said that the PKB witness in Socah Sub-district had objected through the Special D.Genesis form, but a copy of the objection was not given by the Socah Sub-district PPK. Meanwhile, PKB witnesses in Bangkalan Regency have also objected through the Special Occurrence D.form, but PKB witnesses forgot about the objection so they signed theRegency Result D.Bangkalan 1.
