PDIP Petition for Manado 5 Dismissed in PHPU Legislative

JAKARTA (MKRI) —  The Constitutional Court (MK) delivered Decision No 58-01-03-25/PHPU.DPR-DPRD-XXII/2024 for the 2024 DPR-DPRD (House of Representatives-Regional Legislative Council) election results dispute of Manado City, Electoral District (dapil) Manado 5, North Sulawesi Province, filed by the Indonesian Democratic Party of Struggle (PDI-P). The hearing was held by nine constitutional justices on Wednesday, May 22, 2024 in the Plenary Courtroom,  Building 1 of the Constitutional Court.

“In the case of a quo, the Court is authorized to adjudicate the petitioner's petition. The petition was submitted within the timeframe established in the legislation, and the petitioner has legal standing to file the application,” stated Constitutional Justices Enny Nurbaningsih.

According to the Court, the petitioner should have clearly detailed the errors in the vote count established by the Respondent (KPU) and the correct vote count according to the petitioner, as well as the issues they requested to be adjudicated. However, the petitioner only included a description of various violations. The Court did not find any arguments related to errors in the vote count established by the Respondent and the vote count according to the petitioner.

“[The Court] adjudicated, relating to exceptions: to grant the Respondent’s exception on the obscurity of the petition; relating to the subject matter: to declare the Petitioner’s petition inadmissible,” clarified Chief Justice Suhartoyo while delivering the judgment.
