PDIP Alleges Electoral Violations in Manado 5

JAKARTA (MKRI) - The Indonesian Democratic Party of Struggle (PDIP) filed a petition on the 2024 General Election Results Dispute (PHPU) for Members of the House of Representatives (DPR) with the Constitutional Court (MK). The PDIP's (Petitioner) petition concerns the annulment of General Election Commission’s (KPU) Decree No. 360 of 2024 concerning the Regional Representative Council (DPRD) Membership Election in Manado City, Electoral District (Dapil) Manado 5, North Sulawesi Province.

The Preliminary Hearing to examine the petitioner's request was held in Panel 3 of the Court on Friday (05/03/2024). It was presided over by Constitutional Justice Arief Hidayat, accompanied by Constitutional Justice Anwar Usman and Constitutional Justice Enny Nurbaningsih.

In the essence of the Case No. 58-01-03-25/PHPU.DPR-DPRD-XXII/2024, through Legal Counsel Mulyadi Marks Philian, the Petitioner stated indications of election violations occurred at Polling Station (TPS) 9, Banjer Village, Tikala District, Manado City 2, and at TPS 10, Banjer Village, Tikala District, Manado City, before the Panel of Justices. At TPS 9, two voters were found listed in the special voter list (DPK) under the names of Afni Sambang, a resident of Kalaodi Village, Tidore Timur District, Tidore City, and Seny Meidy Eman, a resident of Paslaten Village, Kakas District, Minahasa Regency.

"Both of the aforementioned voters did not meet the requirements as voters in the DPK because they were registered in the voter list of other TPS and their Resident ID Cards (KTP) were also not addressed to TPS 9, Banjer Village, Tikala District, Manado City.'" stated Petitioner’s Legal Counsel Mulyadi.

Additionally, election violations were also found at TPS 10, Banjer Village, Tikala District, Manado City, where two voters were found listed in the DPK under the names of Miguel Reynaldo Rambing, registered at TPS 96 in Pekayon Village, Pasar Rebo District, East Jakarta, and Kasmiati, registered in the voter list of TPS 12 in Wawonasa Village, Singkil District, Manado City 5. Both voters did not meet the requirements as voters in the DPK because they were registered in the voter list of other TPS and their IDs were also not addressed to TPS 10, Banjer Village, Tikala District, Manado City.

The violations disclosed above pertains to the DPK at TPS 9 and TPS 10 have disadvantaged the Petitioner for the filling of the Manado City DPRD membership, Dapil Manado 5, for the acquisition of the 7th seat. Therefore, it can be concluded that the vote acquisition stipulated by the KPU (Respondent) was not based on the process stipulated in the Election Law. This is because four voters listed in the DPK and who cast ballots did not qualify as voters listed in the DPK. Consequently, this situation met the criteria for a recount at TPS 9 and TPS 10.

"The purpose of filing this petition is, if a recount is conducted without any violations at TPS 9 and 10, then there is an opportunity for us (Petitioner) to gain votes," stated Mulyadi.

Therefore, in the Petitum read out in front of the Panel of Justices and the attending parties, the Petitioner requests the Court to annul KPU’s Decree No. 360 of 2024 on the Election Results Stipulation announced on Wednesday, March 20, 2024, at 22:19 WIB, concerning the DPRD Membership Election in Manado City, Dapil Manado 5.
