JAKARTA, MKRI -   The Constitutional Court (MK) delivered during a hearing No. 260-01-12-18/PHPU.DPR-DPRD-XXII/2024 for the 2024 DPR-DPRD (House of Representatives-Regional Legislative Council) election results dispute.  The case was petitioned by the National Mandate Party (PAN) for the electoral district of west Nusa Tenggara province, on Tuesday, May 21, 2024.

Constitutional Justice Arsul Sani in legal considerations said the Court found contradictions between the petitions submitted to the Court. On one side, the Petitioner requested to determine the correct vote acquisition results, while on the other hand requested that the Court order a re-voting. For this reason, the Court is impossible to grant the petitum unless it is requested alternatively and not cumulatively. As a result Arsul continued, causing the Petitioner's to be obscure.

“[The Court] adjudicated, relating to exceptions: to grant the Respondent’s exception on the obscurity of the petition; relating to the subject matter: to declare the Petitioner’s petition inadmissible,”  said Chief Justice Suhartoyo.

For information, the Petitioner mentioned that the comparison of PKS and PAN votes in five districts was different between the data of the Petitioner and the Respondent. According to the Respondent, PKS received 97,096 votes and PAN 96,648 votes, while according to the Petitioner, PKS received 96,632 votes and PAN 97,133 votes. This vote difference occurred in Wadukopa Village, Suromandi District, Bima Regency, due to the transfer of votes by local PKKS employees to PKS, so that the last seat that should have belonged to PAN shifted to PKS.  Based on this description. The Petitioner requests that the Court cancel KPU Decree No. 360 of 2024 throughout the NTB I constituency, determine the correct vote acquisition according to the Petitioner, and order the Respondent to organize a re-voting at TPS 007 Mawu Village, TPS 14 and TPS 19 Nipa Village, and TPS 01 - 07 Kole Village.
