No DPP’s Approval, PKB Candidate’s Petition in East Java Dismissed

JAKARTA (MKRI) — The Constitutional Court (MK) dismissed case No. 276-02-01-15/PHPU.DPR-DPRD-XXII/2024 filed by Alyadi, a candidate for the East Java Provincial DPRD (Regional Legislative Council) from the National Awakening Party (PKB). The Court found that he had not obtained approval from the DPP (central executive board) of PKB to submit the election results dispute (PHPU) petition to the Court.

“The Court adjudicated, relating to the subject matter: to declare the Petitioner’s petition inadmissible,” said Chief Justice Suhartoyo at the ruling hearing in the plenary courtroom on Wednesday May 22, 2024.

Delivering the Court’s legal considerations, Deputy Chief Justice Saldi Isra explained that a petitioner filing a PHPU petition must obtain written approval from the chairman and secretary-general or equivalent positions of the political party participating in the election. This approval is an essential requirement for filing a PHPU case for legislative candidates in the Court.

“In essence, only political parties can file a petition of election results disputes for seats in the DPR (House of Representative), Provincial DPRD, and Regency/City DPRD,” he stated.

The Petitioner did not attach the approval letter from PKB’s DPP when filing the petition. Based on this fact, the Court found that the he did not comply with Article 8 paragraph (3) of Constitutional Court Regulation No. 2 of 2023 and, therefore, did not have the legal standing to file the petition.

Alyadi (the Petitioner), a candidate for the East Java Provincial DPRD from PKB, contested the vote discrepancy in the electoral district of East Java 14. He claimed to have received 154,329 votes, while another PKB candidate, Nur Faizin, should have received 140,179 votes. However, the KPU reported that Alyadi received 150,284 votes and Nur Faizin received 164,222 votes. According to the Petitioner’s evidence, there were significant discrepancies between the polling station C-Results and D-Results forms in Arjasa Subdistrict and Sumenep Regency. The vote shifts and inflations favored Nur Faizin and disadvantaged the Petitioner.
