Late to File Petition, Democrat’s Petition Dismissed

JAKARTA (MKRI) — The Constitutional Court (MK) dismissed case No. 89-02-14-37/PHPU.DPR-DPRD-XXII/2024 on the 2024 election results dispute (PHPU). The case was filed by Letena Liwiya, candidate number 6 for the Tolikara Regency DPRD (Regional Legislative Council) from the Democratic Party in electoral district 1.

“[The Court] adjudicated, relating to the subject matter: to declare the Petitioner’s petition inadmissible,” said Chief Justice Suhartoyo alongside the other eight constitutional justices at a ruling hearing in the plenary courtroom on Wednesday May 22, 2024.

He stated that the petition did not meet the formal requirements of Article 74 paragraph (3) of the Constitutional Court Law, Article 474 paragraph (2) of the Election Law, and Article 7 paragraph (1) of Constitutional Court Regulation No. 2 of 2023. Thus, the Respondent’s (General Elections Commission/KPU) and Relevant Party’s exceptions about the late submission were legally valid. The Court concluded the petition was filed past the deadline set by the regulations.

Although the Court had the authority to adjudicate the petition, it was filed after the deadline, rendering the Respondent’s answers and objections, the Relevant Party’s statements and objections, Bawaslu’s statements, the Petitioner’s legal standing, and the merits of the petition irrelevant therefore and not considered.

The Respondent announced the Decree No. 360 of 2024 on March 20, 2024 at 22:19 WIB, making the filing deadline March 23, 2024, at 22:19 WIB. However, the Petitioner filed the PHPU petition on April 17, 2024, at 14:08 WIB.

The Petitioner challenged the vote discrepancy for the DPRD Tolikara Regency election in electoral district 1, which spanned 12 districts. The Petitioner requested that the Court annul the KPU Decree No. 360 of 2024 on the certification of the results of the 2024 election for the Tolikara Regency DPRD election, electoral district 1, Papua Pegunungan for the Democratic Party candidate number 6, to certify that the correct vote count for the Petitioner for the filling of DPR in the electoral district Tolikara 4 of Papua Pegunungan for the Democratic Party 2,501 votes.
