Court Dismissed Gerindra's Petition for South Papua

JAKARTA (MKRI) — The Constitutional Court (MK) delivered a ruling for the 2024 DPR-DPRD (House of Representatives-Regional Legislative Council) of Papua Province election results dispute filed by the Great Movement Party (Gerindra) on Wednesday, May 22, 2024. The ruling hearing on Case No 274-01-02-35/PHPU.DPR-DPRD-XXII/2024 was presided over by Chief Justice Suhartoyo, accompanied by the other eight Constitutional Justices.

“In the main petition, the Petitioner’s petition is declared inadmissible,” stated Chief Justice Suhartoyo.

In the legal opinion delivered by Constitutional Justice M. Guntur Hamzah, it was stated that the petition does not meet the qualifications as stipulated in Article 75 of the Constitutional Court Law and Article 11 paragraph (2) letters b number 4 and number 5 of Regulation PMK 2/2023. This conclusion was based on the lack of clarity in the Petitioner’s description of the alleged errors in the announced vote counts by the Respondent and the correct counts according to the Petitioner, as well as a mismatch between the grounds for the petitioned (posita) and the relief sought from the Court (petitum). Furthermore, the petition was found to be contradictory (contradictio in terminis). Therefore, the Court found no doubt in declaring that the Respondent’s objection regarding the ambiguity of the petition is legally justified. “Consequently, the Court finds the petition to be vague (obscuur),” explained Guntur.

Previously, Gerindra filed an 2024 Election Result Dispute to the Constitutional Court in South Papua Province. The petitioner claimed a margin of 23,105 votes, attributing this to a reduction in their votes in the tally established by the respondent. Additionally, there was an increase of 23,105 votes for the National Awakening Party (PKB)  in Asmat Regency, attributed to Kristosimus Yohanes Agawemu from PKB. This increase was alleged to be baseless and not grounded in legally valid vote counts as per the official results from Asmat Regency. (*)
