JAKARTA, HUMAS MKRI – The Great Movement (Gerindra) Party, Filed a petition for General Election Results Dispute (PHPU) of 2024 to Constitutional Court (MK) in South Papua Province. The disputed election results affect the acquisition of seats for members of the House of Representatives (DPR), Provincial Regional Legislative Council (DPRD) or called Papuan People’s Representatives’ Council (DPRP), Regency/City DPRD or called Aceh Regency/City Legislative Council (DPRK) in South Papua Province.
“Gerindra said according to Respondent (KPU) is 266 votes, while according to the Petitioner is 22,051—differences of 19,385. PKB according to the Respondent 490 votes, the Petitioner 19,385 votes," said Arsi Divinubun as the Petitioner's attorney in the Plenary Session Room of Building 1 of the Constitutional Court, Central Jakarta on Friday (3/5/2024). Case Number 274-01-02-35/PHPU.DPR-DPRD-XXII/2024 was heard in Panel 1 presided over by Chief Justice Suhartoyo with Constitutional Justice Daniel Yusmic P. Foekh and Justice M. Guntur Hamzah.
According to the petitioner, the difference is 23.105 was due to a reduction of the petitioner’s votes determined by the respondent.
The addition of votes for the National Awakening Party (PKB) in Asmat Regency was 23,105 votes in the name of Kristosimus Yohanes Agawemu from the PKB Party. The additional votes were not based on legally valid votes obtained in the form of D.Results for Asmat Regency.
Regarding to the reduction of the Petitioner's votes, the Petitioner had submitted an objection by filling in an objection form but the Respondent had ignored the Petitioner's objection at the plenary determination at the South Papua provincial level. The Respondent made this reduction based on D. The results of the determination at the Asmat Regency level meant that the Petitioner's vote tally did not change and included the Petitioner's vote tally in several districts in Mappi Regency. According to the Petitioner, the difference in votes above was due to a reduction in the Petitioner's votes in 15 districts in Mappi Regency, amounting to 15,565 votes which had been transferred to the votes of the PKB Legislative Candidate in the name of Kristosimus Yohanes Agawemu.
For this reason, in his petitum, the Petitioner asked the Constitutional Court to annul the the General Election Commission Decree No. 360 of 2024 along the Electoral District of Asmat, South Papua Province for filling candidates for DPR members. Determining the correct vote results according to the Petitioner to fill the DPR members, in the South Papua Electoral District, Asmat Regency with 22,051 votes and the South Papua Electoral District, Mappi Regency with 23,404 votes.
