JAKARTA (MKRI) — The Constitutional Court (MK) approved the withdrawal of Case No. 273-01-12-35/PHPU.DPR-DPRD-XXII/2024 on the 2024 DPR-DPRD (House of Representatives-Regional Legislative Council) election results dispute for the electoral district of South Papua on Wednesday morning, May 22, 2024. The ruling hearing was presided over by Chief Justice Suhartoyo and the other eight constitutional justices.
“[The Court] stipulates: to approve the withdrawal of the Petitioner’s petition, to declare the petition in case No. 273-01-12-35/PHPU.DPR-DPRD-XXII/2024 on the annulment of the KPU Decree No. 360 of 2024 on the certification of the 2024 legislative election results of the DPR (House of Representatives), DPD (Regional Representatives Council), and Provincial and Regency/City DPRD (Regional Legislative Council), specifically for the electoral district of South Papua, withdrawn,” said Chief Justice Suhartoyo delivering the verdict.
In the decree, delivered by Constitutional Justice M. Guntur Hamzah, it is mentioned that the justice deliberation meeting on May 15, 2024 had concluded that the Petitioner’s request for withdrawal was legally warranted and the Petitioner could not refile the a quo petition. The Court ordered the chief registrar to return copies of the case files to the Petitioner.

This petition was filed by the National Mandate Party (PAN), represented by chairman Zulkifli Hasan and secretary-general Eddy Soeparno, for the election of DPRD members in the electoral district of South Papua with the object the General Elections Commission (KPU) Decree No. 360 of 2024.
At the preliminary hearing, the Petitioner, through legal counsel Moh. Fahruddin, submitted the withdrawal of the petition, which had been signed by PAN chairman Zulkifli Hasan. The Petitioner argued that violations had occurred during the recapitulation at all polling stations in Obaa and Miyanmur Districts, necessitating a recount of the votes.
