JAKARTA (MKRI) — The Constitutional Court (MK) rejected the petition filed by Akulius Widigipa, a candidate for the Intan Jaya Regency DPRD (Regional Legislative Council) from the National Mandate Party (PAN). The panel declared that Case No. 141-02-12-36/PHPU.DPR-DPRD-XXII/2024 did not meet the formal requirements as the Petitioner lacked legal standing. The ruling hearing was held on Tuesday May 21 2024 in the plenary courtroom.
“The Court adjudicated, relating to the exception: to reject the Respondent’s exception in its entirety; relating the subject matter: to declare the Petitioner’s petition inadmissible,” stated Chief Justice Suhartoyo, accompanied by the other constitutional justices.
The Court noted that the Petitioner had submitted a recommendation from PAN’s Intan Jaya regional executive board (DPD), signed by Yosef Tapani and Aner Maisini. However, the Court found this insufficient for an individual election dispute petition, as it lacked signatures from the PAN’s central executive board (DPP) chairman and secretary-general, a requirement under Article 3 paragraph (1) letter b in conjunction with Article 8 paragraph (3) of Constitutional Court Regulation (PMK) No. 2 of 2023
