KPU Confirms PAN Candidates in Intan Jaya 3 Received Zero Votes

JAKARTA, MKRI – The Constitutional Court (MK) held a follow-up hearing with the agenda of listening to the Respondent's answer and the Election Supervisory Body (Bawaslu) statement for the Dispute over General Election Results (PHPU) of candidates for Regional House of Representatives (DPRD) of Intan Jaya Regency, Intan Jaya Electoral District 3. Case No.  141-02-12-36/PHPU.DPR-DPRD-XXII/2024 was filed by Akulius Widigipa, a candidate for Intan Jaya Regency DPRD member from the National Mandate Party (PAN).

This case was held in Panel 3 on Monday, May 07, 2024 heard by Constitutional Justices Arief Hidayat (panel chair), Anwar Usman, and Enny Nurbaningsih.

In this hearing, the KPU as the Respondent provided answers related to the argument that there was a significant difference between the vote acquisition determined by the KPU and the data owned by the Petitioner. The Petitioner claimed 3,744 votes, but the KPU recorded that he did not get any votes or zero.

Nyoman Yustita P. Rahardjo, KPU's legal counsel, stated that the arguments of the Petitioner's posita mentioned that polling committee (PPS) and the regional election committee (PPD) deliberately eliminated votes and transferred them to other candidates in one party as many as 3,744 votes in the Intan Jaya III Election District specifically in the Biandoga District area spread across 16 (sixteen) polling stations in 5 (five) villages. However, according to him, the Court  does not have the authority to examine and adjudicate the case because it is included in the realm of electoral criminal law regulated in Article 551 of Law No. 7 of 2017.

Nyoman Yustita P. Rahardjo stated that the Petitioner's petition was obscuur libel because there was no detailed explanation regarding the transfer of the Petitioner's votes to Candidate Number 9 on behalf of Tomas Agimbau. Although the Petitioner mentioned the transfer of 3,744 votes in 16 polling stations, the Petitioner could not explain in detail how the transfer occurred.

No Vote Disappearance

In the main case, the KPU answered that all of the Petitioner's arguments were incorrect.  According to the KPU, the Petitioner's vote is zero, not 3,744 votes. The Petitioner's statement about the loss and robbery of 3,744 votes is not true. In fact, the Petitioner could not mention exactly how many votes at the polling station level and the overall total.

In the petitum, the Respondent asks the Court to decide to accept the Respondent's exception in its entirety, reject the entire petition and declare as true the KPU  Decree No. 360 of 2024.

Petitioner's vote is zero

In the hearing, Bawaslu also explained that based on the results of Bawaslu's supervision of the Sub-District C-Results which were juxtaposed with the Intan Jaya Regency D-Result data on behalf of Akulius Widigipa S.M., the vote acquisition recorded in the Sub-District D-Results and Intan Jaya Regency D-Results was zero.

Bawaslu also explained that they had issued a recommendation to the Intan Jaya Regency KPU through Letter No. 083/Rekom.01.01/K.PT/08/111/2024, regarding Recommendations for Cancellation of Intan Jaya Regency Plenary Vote Results dated March 4, which asked the Intan Jaya Regency KPU and PPD in each District to immediately submit the Model C-Results Form and the District/District D-Results Form to the Intan Jaya Regency Bawaslu. The recommendation has been followed up with the issuance of Event Certificate No. 230/PL.01.8-BA/9407/2024 concerning the Acceptance of the Results of the Recapitulation of Vote Acquisition Calculation of Model C-Results Form dated March 1, 2024 from the Intan Jaya Regency KPU.

At the end, the Intan Jaya Regency KPU has followed up on the Recommendation, the Intan Jaya Regency Bawaslu issued a cancellation of the Recommendation based on Recommendation Letter No. 085/Rekom.01.01/K.PT/081111/2024 regarding Cancellation of Recommendation Letter dated March 5, 2024.
