PBB’s Petition on Vote Margin in Mimika Dismissed

JAKARTA (MKRI) — The Constitutional Court (MK) declared the 2024 House of Representatives (DPR) and Regional Legislative Council (DPRD) election results dispute (PHPU) petitioned by the Crescent Star Party (PBB) for Central Papua inadmissible. The ruling hearing for Decree No. 27-01-13-36/PHPU.DPR-DPRD-XXII/2024 was presided over by all nine constitutional justices on Tuesday, May 21, 2024 in the plenary courtroom.

In its legal opinion, the Court asserts that it had the authority to hear the case. In addition, the Petitioner’s petition was filed within the specified deadline and the Petitioner also had legal standing to file the case to the Court.

“In the subject matter, the Petitioner questioned the difference where his 3,464 votes were determined by the Respondent as 212 votes. In the petition, it did not elaborate on the changes in the vote count at which polling stations or in which districts clearly and in detail. Although there were differences in the results of the Petitioner’s and Respondent’s versions of the votes at the regency level, it did not mention details regarding the location of the district where the difference or change occurred. Therefore, the argument of the a quo petition was vague,” Justice Arif Hidayat said.

In the petition, the acquisition of 3,464 votes, where 1,913 votes were obtained by legislative candidate Max A. Weluken, was not elaborated. The Petitioner only requested that the Court determine the correct vote count according to its version. Therefore, there is a discrepancy between the posita and what was requested to the Court.

“In its verdict, the Court declares the Petition dismissed,” said Chief Justice Suhartoyo, reading out the verdict.
