JAKARTA (MKRI) — The Crescent Star Party (PBB) challenges the General Elections Commission (KPU) Decree No. 360 of 2024 on the certification of the results of the 2024 election of the DPR (House of Representatives), Provincial and Regency/City DPRD (Regional Legislative Council) announced on Wednesday, March 20, 2024 at 22.19 WIB for Mimika Regency DPRD in the electoral district (dapil) of Mimika 4, Central Papua Province. The preliminary hearing of Case No. 27-01-13-36/PHPU.DPR-DPRD-XXII/2024 was presided over by Constitutional Justice Arief Hidayat, accompanied by Constitutional Justice M. Guntur Hamzah and Constitutional Justice Enny Nurbaningsih on Monday, April 29, 2024 at the Constitutional Court (MK).
Vote Margin
Through attorney Langen Subha Pangestu, PBB (Petitioner) argued that there was a vote margin in the vote count conducted by the KPU (Respondent). This resulted to the Petitioner losing votes they should have obtained.
"There was a vote margin in Mimika Dapil 4 obtained by PBB as the Petitioner. According to Form C Result, the Petitioner obtained 3,464 votes, while according to the Respondent, the Petitioner obtained 212 votes," Langen said during the hearing.
Langen stated that there is a vote margin of 3,252 votes that should have been obtained by PBB. Furthermore, Langen explained the riots occured in in Dapil Mimika 4, the Mimika Regency, Central Papua Province. This occurrence prevented the Petitioner from reporting the vote margin to the relevant party, identified as the Elections Supervisory Body (Bawaslu).
Therefore, PBB in its petitum requests the Court to annul the Respondent's Decision. Additionally, PBB requests the Court to determine the correct vote count according to the Petitioner for filling the membership of the Mimika Regency DPRD 4.
