No PSI Approval, Jayapura City 1 DPRD Candidate’s Petition Dismissed

JAKARTA (MKRI) — The Constitutional Court (MK) dismissed the petition for the 2024 DPR-DPRD (House of Representatives-Regional Legislative Council) election results dispute petitioned by Sichard Elfriets Mual, Jayapura DPRD candidate from PSI (Indonesian Solidarity Party) for electoral district 1. The Court asserted that he had not received approval from the party’s leadership to file a petition to the Court as an individual.

“[The Court] rules to declare the Petitioner’s petition inadmissible,” said Chief Justice Suhartoyo at the ruling hearing for case No. 26-02-15-33/PHPU.DPR-DPRD-XXII/2024 in the plenary courtroom on Tuesday, May 21, 2024.

Constitutional Justice Ridwan Mansyur explained that the Petitioner did not attach a letter of approval signed by PSI’s chairman and secretary-general. When the proceedings took place, the Court received a letter that stated that PSI’s chairman and secretary-general had never given a written approval to the Petitioner to file an individual election dispute petition to the Constitutional Court. For this reason, the Court believes that the Petitioner did not have legal standing to file the petition.

“Based on the legal fact, the Court believes the Petitioner does not fulfill the provisions of Article 8 paragraph (3) of Constitutional Court Regulation No. 2 of 2023. Thus, he does not have legal standing to file the petition,” Justice Ridwan stressed.

Previously, in his petition, the Petitioner felt harmed due to vote inflation, so his ranking fell. He asserted his votes were superior with 981 votes in seven villages in South Jayapura. However, his votes were lost at the district-level plenary meeting in several villages totaling 103 votes. The votes for candidate number 2 Armaya Latuperisa Siregar were inflated from 596 to 1,180. However, the witness on duty did not object when there were changes to the recapitulation of the results when read out by the district election committee (PPD).
