JAKARTA (MKRI) — The Constitutional Court (MK) dismissed the petition for the 2024 DPR-DPRD (House of Representatives-Regional Legislative Council) election results dispute for case No. 216-01-17-23/PHPU.DPR-DPRD-XXII/2024 on Tuesday, May 21, 2024. The case was petitioned by the United Development Party (PPP) regarding the transfer of votes to the Indonesian Guard of Change Party (Garuda) in East Kalimantan.
In its legal considerations, delivered by Constitutional Justice Saldi Isra, the Court asserts that the locus in the petition did not match: East Kalimantan and Central Java III. As a result, the petition was not only difficult to understand, but was also unclear. In the revised petition, the Petitioner presented the vote acquisition in the East Kalimantan, but did not explain the vote transfer in question. It also mentioned the transfer of votes in the electoral district of Central Java III. With these legal facts, continued Deputy Chief Justice Saldi, the petition’s ambiguity became apparent. In addition, the Petitioner did not mention in detail the level of recapitulation at which the Petitioner's votes were transferred to Garuda.
“[The Court] declares the Petitioner’s petition inadmissible,” said Chief Justice Suhartoyo in the plenary courtroom alongside the other constitutional justices.

The Petitioner stated that the transfer of PPP’s votes to another party could be seen from the comparison of the votes, where PPP’s vote acquisition according to the Respondent was 38,578 votes and according to the Petitioner 43,63. Meanwhile, according to the Respondent Garuda obtained 5,158 votes and according to the Petitioner 97 votes. This illegal vote transfer continued until the national recapitulation. This issue has been reported to the Provincial Bawaslu in the electoral district concerned. The Petitioner requests the Court to determine the correct vote results for PPP as 43,639 votes and 97 votes for Garuda, and to order the KPU to implement this decision.
