Locus Unclear, KPU Denies PPP’s Votes Transferred in East Kalimantan

JAKARTA (MKRI) — The Constitutional Court (MK) held a follow-up hearing on the 2024 election results dispute for the DPR (House of Representatives), Provincial and Regency/City DPRD (Regional Legislative Council) on Tuesday, May 7, 2024. The second hearing for case No. 216-01-17-23/PHPU.DPR-DPRD-XXII/2024, petitioned by the United Development Party (PPP), was presided over by Deputy Chief Justice Saldi Isra (panel chair) with the Constitutional Justices Ridwan Mansyur and Arsul Sani on Panel 2.

The KPU (General Elections Commission) as Respondent through R. Liani Afrianty delivered a response to the Petitioner’s (PPP) argument that there had been an unauthorized transfer of the Petitioner’s votes to Garuda (Indonesian Guard of Change Party) in East Kalimantan. According to the Respondent, the Petitioner’s petition was inconsistent in determining the locus of the vote transfer, as it stated that it had been for the DPR election in Central Java III. In addition, the Petitioner did not explain the details of the differences in vote counts in 35 electoral districts spread across 19 provinces.

“The Petitioner is also said to have expressed its objection to Bawaslu (Elections Supervisory Body), but it failed to explain the locus. The recapitulation process is always carried out in stages, starting from polling station, subdistrict, regency, province, and nationally. Thus, we request the Court to validate the KPU Decree No. 360 of 2024 as it pertains to the results of the DPR election in East Kalimantan Province,” said Liani.

Incidents

On behalf of the East Kalimantan Bawaslu, Galeh Akbar Tanjung said that based on the supervision report, the elections supervisory committee (Panwaslu) of Long Apari Subdistrict had supervised the recapitulation and there was an incident of writing error at TPS (polling station) 01 of Long Penaneh I Village. There was one vote for PPP for DPR but was invalid, so the invalid ballots became 10. There was also an incident in Long Penaneh II Village, where there was an invalid vote for PPP’s candidate number 6 for DPR.

“Based on the recapitulation on the subdistrict D-result form of Long Apari Subdistrict results, PPP had 0 votes. However, on the regency D-result form, there was a correction from 0 vote to 4 votes,” said Galeh.
