JAKARTA, (MKRI) — The Constitutional Court (MK) dismissed the petition filed by Julianus Agimbau, a DPRD candidate for the electoral district of Intan Jaya Regency 3 No. 8 from the National Democratic Party (NasDem). The constitutional justices declared that Case No. 126-02-05-36/PHPU.DPR-DPRD-XXII/2024 did not meet the formal requirements as the Petitioner lacked legal standing. The ruling was delivered on Tuesday, May 21, 2024 in the plenary courtroom.
“[The Court] adjudicated, relating to objections: to grant the Respondent’s objection regarding the Petitioner’s legal standing, and to dismiss the Respondent’s for the rest and remainder; relating to the subject matter: to declare the Petitioner’s petition inadmissible,” stated Chief Justice Suhartoyo alongside other constitutional justices.
The Court stated that the Petitioner did not include a letter of approval from the political party to file a petition as an individual legislative candidate. After examining the Petitioner’s petition files and evidence based on the electronic petition filing certificate (e-AP3), the Court found that the Petitioner only attached a recommendation letter signed by the chairman and secretary of the regional executive board of NasDem in Intan Jaya Regency, without a recommendation or approval letter signed by the chairman and secretary-general of the central executive board of NasDem.
“The Petitioner lacked an approval letter from NasDem to file a petition as an individual legislative candidate. Upon reviewing the petition and evidence, including the electronic petition filing certificate (e-AP3), it was found that the Petitioner only submitted a recommendation letter from NasDem’s regional executive board in Intan Jaya Regency, missing a recommendation or approval letter signed by the chairman and secretary-general of the central executive board,” said Constitutional Justice Arief Hidayat, reading the legal considerations.

The Petitioner claimed a discrepancy between the General Elections Commission’s vote count and their own, stating through legal counsel Regio Alfala Rayandra that they should have received 3,528 votes, but were recorded as zero votes.
