JAKARTA (MKRI) — The Constitutional Court (MK) held the preliminary hearing for the 2024 Regional Legislative Council (DPRD) election results dispute of the electoral district (dapil) 3 of Intan Jaya Regency on Monday afternoon, April 29, 2024. The case No. 126-02-05-36/PHPU.DPR-DPRD-XXII/2024 was filed by Julianus Agimbau, National Democratic Party (Nasdem) DPRD candidate number 8 for Dapil 3 of Intan Jaya Regency, Central Papua Province.
In the preliminary hearing presided over by Constitutional Justices Arief Hidayat (panel chair), Anwar Usman, and Enny Nurbaningsih, the Petitioner argues that there was a margin between the election results certified by the Respondent (General Election Commission [KPU]) and his version.
According to legal counsil Regio Alfala Rayandra, the Petitioner's vote should have been 3,528 votes, but based on the results certified by the Respondent, the Petitioner's vote was zero.
"Julianus Agimbau's vote was zeroed out and he claims that his vote was transferred, thus it should have been 3,528 (votes)," he said.
The Petitioner argues that the margin was caused by the removal of his votes from four villages totaling 3,528 votes. The reduction in votes was because the Petitioner's votes were stolen and/or eliminated by unscrupulous members of the district election committee (PPD) and the polling committee (PPS).
The Petitioner claims that his votes were stolen and/or removed, then transferred and added to the votes of other DPRD candidates of Intan Jaya Regency from the Nasdem.
Aside from that, the Petitioner also challenges the process of conducting general elections that were not in accordance with the principles of direct, public, free, confidential, honest and fair (luber and jurdil) as provided for by the statutory laws and regulations.
Therefore, the Petitioner requests the Court to grant his petition in its entirety, to cancel the KPU Decree No. 360 of 2024, and to certify his version of the vote acquisition results or order the Intan Jaya Regency KPU to conduct a re-vote (PSU) in all districts including in Intan Jaya Election District 3 which are Biandoga District, Agisiga District and Tomosiga District.
