JAKARTA (MKRI) — The Constitutional Court (MK) issued Decision Number 72-01-10-36/PHPU.DPR-DPRD-XXII/2024 in the case of the 2024 Election Dispute (PHPU) of Members of DPR (House of Representatives) and DPRD (Regional Representative Councils) filed by the People's Conscience Party (Hanura). The hearing was held by nine constitutional justices on Tuesday, May 21, 2024, in the Plenary Courtroom.

"The Court has the authority to adjudicate the a quo petition. The petition was filed within the time limit for filing a petition," said Constitutional Justice Arief Hidayat delivering the legal considerations. 

The Court concluded that there was ambiguity in the Petitioner's petition due to the lack of description regarding the clear miscount of votes in certain polling stations (TPS) or sub-districts in the Petitioner's petition for filling the position of member of the Mimika Regency DPRD in Mimika 3. Furthermore, there was inconsistency between the arguments in the posita and petitum for filling the position of members of the Central Papua Regional Representative Council (DPRPT) in Central Papua 5, as well as filling the position of members of the Mimika Regency DPRD in Mimika 3. 

Therefore, as per the Court's ruling, despite its authority to adjudicate the Petitioner's petition, which was filed within the stipulated period, and acknowledging the Petitioner's legal standing to file the petition, the obscurity of the Petitioner's petition justifies the Relevant Party's exception. Consequently, the substance of the Petitioner's petition is not further considered.
