JAKARTA (MKRI) — The Constitutional Court held a preliminary hearing on the 2024 general election results dispute filed by the People’s Conscience Party (Hanura) for the Provincial and Regency Legislative Council (DPRD) of the election districts of Central Papua 5 and Mimika 3 in Mimika Regency, Central Papua Province. The hearing for case No. 72-01-10-36/PHPU.DPR-DPRD-XXII/2024 was held on Monday April 29, 2024 and presided over by Constitutional Justices Arief Hidayat, Anwar Usman, and Enny Nurbaningsih. Hanura filed the petition to annul the General Elections Commission (KPU) Decree No. 360 of 2024, which was announced on Wednesday March 20, 2024.

When reading the petition’s subject matter in front of the panel, legal counsel juxtaposed the vote acquisition according to the Petitioner and the KPU. The Respondent decided that votes for the National Democratic Party of Struggle (NasDem) were 33,762, while according to the Petitioner, it should have been 31,404. This shows the inflation of 2,358 votes.

“The vote inflation was carried out during the recapitulation of the vote count in Mimika Regency. This can be seen in D model form of the DPRPT results of Wania District, Mimika Regency and D model form of the results of KABKO DPRD of Mimika Regency, Central Papua Province,” said Nurul Azmi.

According to the Petitioner, the 2,358 votes in Wania District were not in accordance with the C model form copies for the Provincial DPRD spread across 159 polling stations and 7 villages.

In the petitum, the Petitioner requests the Court to cancel KPU Decree No. 360 of 2024 on the certification of the 2024 presidential and legislative election results announced nationally for Mimika Regency DPRD. He also requests the Court to certify his version of the vote acquisition for the Provincial and Regency DPRD.
