Court Has No Authority to Rule Gerindra Candidate’s Petition

JAKARTA (MKRI) — The Constitutional Court (MK) stated in Decree No. 157-02-02-12/PHPU.DPR-DPRD-XXII/2024 that it was not authorized to adjudicate the 2024 legislative election results dispute (PHPU) case of the electoral district of West Java I. This petition was filed by a DPR (House of Representatives) candidate Elza Galan Zen from the Great Movement Party (Gerindra). The decree was delivered by Chief Justice Suhartoyo alongside the other eight constitutional justices.

“[The Court] determined, declares that the Court does not have the authority to adjudicate the petition,” said Chief Justice Suhartoyo on Tuesday, May 21, 2024 in the plenary courtroom.

In the decree, the Court said that based on the legal facts, the justice deliberation meeting on May 15, 2024 had concluded that the Petitioner’s petition was not related to the cancellation of the certification of the 2024 legislative election results of the DPR (House of Representatives) and DPRD (Regional Legislative Council) announced nationwide, so the Petitioner’s petition was not an object that the Court had the authority for.

At the preliminary hearing, DPR candidate Elza Galan Zen from Gerindra filed a dispute case for the DPRD election in the electoral district of West Java I.  The Petitioner, who was present without a legal counsel, said that he objected to the results of the KPU’s (General Elections Commission) announcement on February 15 as announced on detik.com. The results displayed by the KPU were a direct count or real count with the acquisition of the top seven rankings.

The Petitioner, in his petitum, requested the Court to provide legal protection for him relating to the loss of vote acquisition data and to hold that a reliable vote that can be used as a reference is input data before the chaos caused by changes in numbers after the data input.
