Court Dismisses Petition by Bandung Regency Branch Vice Treasurer of PDI-P

JAKARTA (MKRI) — The Constitutional Court (MK) dismissed Case No. 227-02-03-12/PHPU.DPR-DPRD-XXII/2024 on the 2024 General Election Results Dispute. The case was petitioned by Mochamad Luthfi Hafiyyah, a Vice Treasurer of the DPC (Branch Executive Board) of the PDI-P (Indonesian Democratic Party of Struggle), who also a DPRD (Regional Legislative Council) candidate for the electoral district of Bandung Regency 4. However, the Petitioner did not attend the preliminary hearing.

“[The Court] to declare the Petitioner’s petition dismissed,” said Chief Justice Suhartoyo in the plenary courtroom, on Tuesday, May 21, 2024.

Constitutional Justice M Guntur Hamzah explained that the Court has summoned the Petitioner lawfully and properly with the chief registrar letter dated April 25, 2024. However, until the preliminary hearing on April 30, 2024, ended, the Petitioner was absent without any valid reason..

As stipulated in Article 42 paragraph (2) of Constitutional Court Regulation No. 2 of 2023, if the Petitioner and/or legal counsel does not attend the preliminary hearing without a valid reason despite having been legally and properly summoned, the Court declares the petition dismissed. Thus, in the justice deliberation meeting (RPH), the Court concluded that the Petitioner’s absence without any valid reason showed that the Petitioner did not file the petition seriously.

The Court believes there is no need to hold another session to hear the responses of the Respondent (General Elections Commission), the Relevant Party, and Bawaslu (Elections Supervisory Body) since they would be irrelevant. As such, those responses were not considered any further.

In the petition, the Petitioner alleged that there had been violation of transfer votes from PDIP to the PKB (National Awakening Party). The Petitioner requested the Court to declare that the vote acquisition of the PDIP amounted to 27,011 votes and the PKB amounted to 44,440 votes for the DPRD election in Bandung Regency 4.
