KPU Denies Reducing Democrat Candidates’ Votes in Papua Pegunungan

JAKARTA (MKRI) — The General Election Commission (KPU) refuted any reduction or addition of vote acquisition for political parties in the House of Representatives (DPR) elections in the electoral district of Papua Pegunungan. This was stated by Rahman Ramli representing the KPU (Respondent) in response to the petition in Case no. 248-01-14-37/PHPU.DPR-DPRD-XXII/2024 filed by the Democratic Party.

The Democratic Party argues that there has been a reduction in the vote acquisition for several of its legislative candidates, including DPR (House of Representatives) candidates for the Papua Pegunungan electoral district, number 1, Willem Wandik, and number 2, Hoerlina Pahabol; Provincial DPRD (Regional Legislative Council) candidates for Papua Pegunungan electoral district 6, Nebon Pahabol, and electoral district 4, Ronny Elopere; as well as DPRD candidates for Yahukimo Regency electoral district 7, Pendi Keroman. According to the KPU, the accurate vote counts for each candidate are: Willem Wandik with 65,738 votes, Hoerlina Pahabol with 24,425 votes, Nebon Pahabol with 0 votes, Ronny Elopere with 2,590 votes, and Pendi Keroman with 5,050 votes.

Furthermore, the KPU stated that the Petitioner incorrectly designated document no. 217/PL.01.08-BA/05/2024 as the subject of the dispute, which should have been document no. 218/PL.01.08-BA/05/2024 on the Stipulation of the National Level Vote Count Results in the Simultaneous General Election of 2024 based on KPU Decree No. 360 of 2024. Additionally, in their petition, the Petitioner filed an Election Results Dispute (PHPU) with the Constitutional Court (MK) in West Kalimantan electoral district 1. However, in the substance of their petition, the Petitioner disputes the vote acquisition in Papua Pegunungan.

"Based on the descriptions above, the Petitioner's petition is obscure, imprecise, and ambiguous, thus it should be declared inadmissible," stated Rahman Ramli in the Plenary Hearing Room of Court Building 1, Central Jakarta on Tuesday (14/5/2024). This Case No. was held in Panel 1 presided over by Constitutional Chief Justice Suhartoyo, accompanied by Constitutional Justice Daniel Yusmic P. Foekh and Constitutional Justice M. Guntur Hamzah.

On the other hand, there are the National Democratic Party (NasDem) and National Mandate Party (PAN) who are involved parties in this case. Both, through their respective legal counsels, testified on the election dispute in Papua Pegunungan as alleged by the Democratic Party.

Meanwhile, the Election Supervisory Agency (Bawaslu) mentioned reports regarding the non-execution of vote count recapitulation in the district-level plenary recapitulation according to the consensus form of the noken system. However, these reports were not registered because the reporters did not meet formal and material requirements.

In the petitum, the Petitioner requested the Court to annul KPU Decree No. 360 of 2024 on the Stipulation of the 2024 Legislative Election Results for the DPR (House of Representatives), DPD (Regional Representatives Council), and Provincial and Regency/City DPRD (Regional Legislative Council) announced nationwide on 2024 across all Electoral Districts presented by the Petitioner in their petition. The Petitioner also requested the Court to stipulate the correct vote acquisiton according to the Petitioner for each Electoral District presented by the Petitioner in their posita.
