JAKARTA, (MKRI) — The Democratic Party filed a Dispute over the General Election Results (PHPU) for 2024 with the Constitutional Court (MK), which concerns Papua Pegunungan Province DPR/DPRD (House of Representatives/Regional Legislative Council) seats. The petitioner claimed a reduction in votes for the Democratic Party's legislative candidate (caleg) for the DPR in the Papua Pegunungan electoral district.
The petitioner claimed that the respondent had reduced the votes for Democratic Party candidate number 1, Willem Wandik, in Tolikara Regency. The petitioner claimed that the candidate should have obtained 232,202 votes instead of 65,738 votes, creating a difference of 166,464 votes.
In addition, the petitioner stated they received a total of 209,722 votes from the Papua Pegunungan Province electoral district, specifically from Yahukimo and Jayawijaya Regencies. The petitioner argued that the Democratic Party candidate number 2, Hoerlina Pahabol, should have received these votes as a candidate for the DPR RI.
According to the petitioner, the local Bawaslu has received objections, but the KPU has not responded. "Recommendations have been made but there has been no response," said the petitioner's legal counsel, Novianto Rahmantyo, in the Preliminary Courtroom of Building 1 of the MK, Central Jakarta on Friday May 5 2024. Case No. 248-01-14-37 /PHPU.DPR-DPRD-XXII/2024 is being heard by Panel 1, led by Chief Justice Suhartoyo with Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah.
In the petitum, the petitioner asked the Court to annul the General Elections Commission (KPU) Decree No. 360 of 2024 on the certification of the 2024 legislative election results of the DPR (House of Representatives), DPD (Regional Representatives Council), and Provincial and Regency/City DPRD (Regional Legislative Council) announced nationwide on March 20, 2024 for the electoral districts mentioned by the petitioner in their petition. The petitioner also requests the Court to certify the correct vote acquisition according to the petitioner for each electoral district mentioned by the petitioner in the posita. (*)
