KPU Denies Hanura’s Vote Claim for Tolikara Regency 2

JAKARTA (MKRI) — The Constitutional Court (MK) held a hearing for the election results dispute of Papua Provincial DPRD (Regional Legislative Council) election for the electoral district of Tolikara 2, on Tuesday, May 14, 2024 in the plenary courtroom. The petition No. 257-02-10-37/PHPU.DPR-DPRD-XXII/2024 was filed by the People’s Conscience Party (Hanura).

At the hearing chaired by Chief Justice Suhartoyo, the KPU’s (General Elections Commission) legal counsel Happy Ferovina emphasized that the vote acquisition argued by the Petitioner in its petition came from an invalid source, namely the Petitioner’s agreement with legislative candidates from other political parties. The Petitioner admitted this in points b, c, and d of its petitums, where it argues that it had lost votes in Yowo Village, Kembu District, which came from its agreement with Demes Enumbi, a candidate from the Crescent Star Party (PBB). It lost votes in Nugari and Teoga Villages in Kembu District where it had an agreement with Epen Wonda, and it lost votes in Nangga, Enggawogo, and Wamolo Villages in Gundagi District from her agreement with Weki Wanimbo, a fellow Hanura candidate.

The Petitioner allegation of fraud committed by the Kembu District election committee (PPD) and the Gundagi District PPD as well as cooperation between the Kembu District PPD and the Gundagi District PPD with the Tolikara Regency KPU was false. Recapitulation at the district level in Kembu District and Undagi District as well as recapitulation at the regency level in Tolikara Regency were carried out in accordance with statutory laws and regulations.

“It is not true that, as Petitioner argues in its petition, that the Petitioner have 4,152 votes, because based on the vote count and tiered recapitulation starting from the polling stations (TPS) level to the Tolikara Regency level, the Petitioner’s correct vote acquisition is 0,” said Happy.

Then, she continued, the Petitioner’s argument that it had 4,152 votes in Tolikara Regency is false because it is actually 0 based on the minutes and certificate of recapitulation of the votes for political parties and DPR candidates from subdistricts in the regency/city areas for the electoral district of Tolikara 2 in Tolikara Regency, Papua Pegunungan Province.

In addition, the Petitioner’s argument that the purge of 3,682 of her votes in Kembu and Gundagi Districts designed and planned by the chairman and members of the Kembu and Gundagi PPD by transferring its votes to PDI-P (Indonesian Democratic Party of Struggle) candidate number 2 Eiron Karoba and candidate number 1 Yoel Wakur from Tolikara 2 is wrong.

This is because during the regency level recapitulation there were no witnesses who objected. During the open plenary session at the regency level, Hanura witnesses did not object and never submitted a D-incident form for the regency DPRD election. Besides that, the session was witnessed by all witnesses present, including the Tolikara Regency Bawaslu (Elections Supervisory Body).

Thus, Happy said, all arguments in the petition are not true and have no legal basis, thus the petition must be rejected entirely.

Meanwhile, the Tolikara Regency Bawaslu representative Sanggup Abidin said that there were no findings and reports related to the Petitioner’s petition. “Based on the supervision report dated March 15, 2024, Hanura’s candidate Spendy Weya received 0 votes,” he explained.

Then, he continued, in the regency-level recapitulation in Gundagi District of Tolikara Regency, no D-incident/objection form was submitted to the Tolikara Regency Bawaslu.
