JAKARTA (MKRI) — The Constitutional Court (MK) held a preliminary hearing on the legislative election results dispute (PHPU) of Papua Pegunungan DPRD (Province Regional Legislative Council) Electoral District (Dapil) Tolikara 2 on Friday (5/2/2024) at the plenary courtroom of the Court. The petition of Case No. 257-02-10-37/PHPU.DPR-DPRD-XXII/2024 was filed by the Hanura.
In the hearing that heard by Chief Justice Suhartoyo, legal counsel Amsal Sama revealed that the Petitioner is a People’s Conscience Party (Hanura) candidate number 1 for Tolikara Regency DPRD in the Electoral District (Dapil) of Tolikara 2, which consists of 11 districts. He obtained valid votes based on the Minutes of the Votes Counting Result Record at the Polling Station in the 2024 legislative election of the Tolikara Regency DPRD.
“Based on Tolikara Regency General Elections Commission (KPU) Decree Number 50 of 2024 on Stipulation of legislative election results dispute of Tolikara Regency in Appendix Page 14 stated that Hanura candidate number 10 Spendi Weya, valid votes 470 and ranking valid votes of Candidate 1, very affecting the acquisition of seats for Members of the Tolikara Regency DPRD Papua Pegunungan Province,” he said.
According to the Petition, when the Vote Counting Recapitulation at the polling station (TPS) level, his votes amounted to 3,682 votes, which he obtained and which were given by Demes Enumbi, Epen Wanimbo, and Weki Manimbo, all in safe conditions without any shortcomings. When the Applicant's votes reached 3,682 votes at the Kembu and Gundagi District PPD (district election committee) levels, it turned out that the Chairman and members of the Kembu District PPD and Gundagi District began to play by eliminating his votes and diverting them to other candidates. The method of transferring his votes to PDIP (Indonesian Democratic Party of Struggle) legislative candidates Number 2 on behalf of Eiron Karoba and Yoel Wakur Number 1 from Tolikara District 2. This caused his valid votes to be reduced.
On his petitum, the Petitioner requests the Court to cancel the KPU Decree Number 360 of 2024 as long as the legislative election of Tolikara Regency DPRD, and in Tolikara 2 of Papua Pegununugan from Hanura candidate number 1 on behalf of the Petitioner; Determine the correct vote acquisition results for the filling of the Tolikara Regency DPRD Candidates, Papua Pegunungan Province and in Tolikara 2 Electoral District from Hanura candidate number 1 Spendi Weya, amounting to 3,682 votes.
