JAKARTA (MKRI) - The General Election Commission (KPU) deemed the United Development Party (PPP) as inconsistent in stating three versions of vote acquisition according to the Petition filed in their petition. This was conveyed by the KPU as the Respondent in responding to Case No. 130-01-17-37/PHPU.DPR-DPRD-XXII/2024 on the Election Results Dispute (PHPU) in Papua Pegunungan requested by PPP to the Constitutional Court (MK).
"It is very apparent, clear, and evident the inconsistency or lack of consistency of the Petitioner in stating three versions of vote acquisition according to the Petitioner," said the Respondent’s legal counsel, Hifdzil Alim, in the Plenary Hearing Room of Building 1 of the Court, Central Jakarta on Tuesday (14/5/2024). This case was held in Panel 1 presided over by Constitutional Chief Justice Suhartoyo accompanied by Constitutional Justice Daniel Yusmic P. Foekh and Constitutional Justice M. Guntur Hamzah.
The KPU outlined that when arguing the transfer of vote acquisition to the Indonesian Guard of Change Party (Garuda), PPP stated that the correct vote acquisition according to the Petitioner was 13,660 votes. When mentioning the transfer of vote acquisition to the National Awakening Party (PKB), the Petitioner stated that the correct vote acquisition for PPP was 46,750 votes. Then, when arguing the transfer of vote acquisition to the PKB, the correct vote acquisition for PPP according to the Petitioner was 27,750 votes.
The KPU stated that in the petitum filed by the Petitioner, the correct vote acquisition for PPP according to the Petitioner in the Papua Pegunungan electoral district was also always different and inconsistent. The Petitioner should have accumulated the correct vote acquisition according to the Petitioner so that it would be in a unified number considering that the election was conducted only in one electoral district.
Furthermore, the KPU emphasized that political parties participating in the election who do not acquire a valid national vote of less than 4 percent or do not meet the parliamentary threshold, cannot be included in the calculation of national parliamentary seat acquisition for the House of Representatives (DPR). The KPU stated that the Court does not have the authority to convert PPP votes of 5,878,777 votes or 3.87 percent into seats in the DPR as requested by the Petitioner.
The Relevant Party for this case is the National Awakening Party (PKN). Through its legal counsel, PKN rejects the entire petition filed by the Petitioner or PPP.

Meanwhile, the Election Supervisory Agency (Bawaslu) stated that there were no reports and findings of handling violations in the Papua Pegunungan Province. Bawaslu mentioned that the Elelim City area conducted voting with the mechanism of one person one vote.
In addition, in their petitum, the Petitioner requested the Court to declare that the valid vote acquisition of 5,878,777 acquired by the Petitioner is entitled to be converted into seats in the DPR and to instruct the Respondent to convert the valid vote acquisition of DPR members for 2024 acquired by the Petitioner totaling 5,878,777 in the 2024 National Election into seats in the DPR. Alternatively, the Petitioner requested the Court to annul KPU Decree No. 360 of 2024 on the Stipulation of the 2024 Legislative Election Results for the DPR (House of Representatives), DPD (Regional Representatives Council), and Provincial and Regency/City DPRD (Regional Legislative Council) announced nationwide on March 20, 2024, at 22:19 WIB, including the results of the general election for members of the DPR in the Papua Pegunungan electoral district (4 percent PT conversion) and members of the Yahukimo District DPRD in electoral district 5. The Petitioner also requests the Court to stipulate the correct vote acquisition according to the Petitioner for the DPR member election in the Papua Pegunungan electoral district and to determine the correct vote acquisition of the Petitioner and other parties' votes for the election of members of the Yahukimo District DPRD in Electoral District 5, including PPP correct vote acquisition of 18,704 votes.
