JAKARTA (MKRI) — The United Development Party (PPP) has filed the petition a petition over the 2024 DPR (House of Representatives) election results dispute of the electoral district of Papua Pegunungan. Based on the General Elections Commission (KPU) Decree No. 360 of 2024 on the certification of the national election results, the PPP did not meet the parliamentary threshold of 4 percent, so it did not qualify for DPR seats.
“The condition experienced by the Petitioner has led to injustice because the Constitutional Court Decision No. 116/PUU-XXI/2023 dated February 29, 2024 declared the 4-percent parliamentary threshold unconstitutional and the elimination of the threshold was postponed to 2024,” said the Petitioner’s legal counsel Iqbal Tawakkal Pasaribu in the plenary courtroom on Friday, May 3, 2024. The case No. 130-01-17-37/PHPU.DPR-DPRD-XXII/2024 was heard in Panel 1 presided over by Chief Justice Suhartoyo with Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah.
The Petitioner said it received 5,878,777 votes nationally, or 193,088 votes short of passing the parliamentary threshold. It asks the Court to convert its current votes into DPR seats so that people who had voted for it would have representation in the Parliament.
In its petitum, the Petitioner asks the Court to declare the 5,878,777 valid votes it obtained eligible for conversion into DPR seats, to order the Respondent (KPU) to convert 5,878,777 valid votes for the 2024 DPR election, or to annul KPU Decree No. 360 of 2024 on the certification of the results of the DPR, DPD (Regional Representatives Council), and Provincial and Regency/City DPRD (Regional Legislative Council) in the 2024 election announced nationwide on Wednesday, March 20, 2024 at 22:19 WIB as it pertains to the 2024 DPR election in Papua Pegunungan Province (4-percent presidential threshold conversion) and the Yahukimo Regency DPRD in electoral district 5. The Petitioner also asks the Court to determine the correct vote results according to the Petitioner for the DPR election in the Papua Pegunungan electoral district and determined the correct results of the Petitioner’s votes and the votes of other parties for the DPRD election for Yahukimo 5 as follows: PPP received 18,704 votes.
