JAKARTA (MKRI) — The Constitutional Court (MK) held another hearing on the DPD (Regional Representatives Council) election results dispute of South Papua Province petitioned by Dayana. The follow-up hearing for case No. 11-35/PHPU.DPD-XXII/2024 was held on Monday, May 13, 2024 in the plenary courtroom of the Court and heard by Chief Justice Suhartoyo and Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah. This petition was filed by Dayana, DPD candidate number 5 of South Papua electoral district.
Johanis H. Maturbongs said that the KPU (General Elections Commission) as the Respondent rejected the Petitioner’s argument regarding violations in other regencies in Papua Province as it is irrelevant to the election results in South Papua Province, because Papua Province is different from South Papua Province.
“The Respondent firmly rejects the Petitioner’s arguments because the data submitted by the Petitioner is part of the elections held simultaneously throughout Indonesia on April 17, 2019 but instead contains data from Merauke Regency, Boven Digoel Regency, Mappi and Asmat, on violations committed by the Respondent that have [resulted] in the loss of the Petitioner’s votes,” said Johanis.
Meanwhile, through Ali Asgar Tuhulele, Sularso as the Relevant Party emphasized that the Petitioner was unable to mention clearly and in detail the alleged events and how much influence or significance they had on the Petitioner’s and Relevant Party’s vote acquisition.

Next, through Felix Tethool, Bawaslu explained during the recapitulation of vote count at the Mappi Regency level, Dayana’s witness had signed the attendance list and had no objections to the recapitulation for DPD read by each PPD (district election committee) from Obaa District.
“In the recapitulation of the results of the determination of the plenary results of Mappi Regency, there were no objections from witnesses of political parties or DPD witnesses to the determination of the plenary results of Mappi Regency, which were read out for all types of elections,” he explained.
According to Felix, in the recapitulation of the results of the calculation of votes at the district level, there were no objections from political party witnesses for DPD election, which were read by Obaa District PPD.
