JAKARTA (MKRI) — The Constitutional Court (MK) held a preliminary hearing on election results dispute of Regional Representatives Council (DPD) Provincial South Papua that filed by Dayana. The preliminary hearing with the Case No. 11-35/PHPU.DPD-XXII/2024 was heard by Chief Justice Suhartoyo (Panel’s Chair) and Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah at plenary courtroom of the Court on Friday, May 3, 2024.
"Dayana is DPD candidate number 5 for the South Papua electoral district (dapil)," said the Petitioner's legal counsel Rafli Fatahudin Syamsuri in a hearing that heard Chief Justice Suhartoyo.
The Petitioner argues that the vote acquisition as stated in the D-results at the district or subdistrict level, the vote acquisition is 27,184 votes. But the vote is different from the vote according to the KPU (General Elections Commission) as the Respondent, which is 2,664 votes. This shows that there is a differences of around 24,520 votes.
"Therefore, he has filed an objection by filling out a form issued on March 13, 2024. However, the Respondent ignored the objection. He has filed an objection through the witness at the time before the determination of the results in the determination plenary meeting at the Papua Province Level," he explained.
On his petitum, he requests to the Court to cancel the KPU Decree Number 360 of 2024 and stated that the votes obtained according to the Respondent were not correct because they did not match the votes of the Petitioner. (*)
