KPU Rejects PDI-P’s Request for Revote in Bombana Regency 3

JAKARTA (MKRI) The General Elections Commission (KPU) has dismissed case No. 113-01-03-28/PHPU.DPR-DPRD-XXII/2024 on the 2024 election results dispute (PHPU) filed by the Indonesian Democratic Party of Struggle (PDI-P) for the electoral district (dapil) of Bombana Regency 3 in Southeast Sulawesi Province. Consequently, the KPU as Respondent has denied PDIP’s petitum requesting the Constitutional Court (MK) to order a revote at several polling stations (TPS) in Bombana Regency 3.

“[The request] is entirely unreasonable because all processes of voting, counting, and recapitulation of votes have been correctly conducted by the Respondent, thus not causing any dispute over the election results in electoral district 3 for the Bombana Regency DPRD candidates,” said the Respondent’s legal counsel Ramelan on Monday, May 14, 2024. This case was heard by Panel 1, consisting of Chief Justice Suhartoyo and Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah.

The KPU refuted the Petitioner’s claim that a voter listed in the final voters list (DPT) had voted more than once at TPS 001 in Ranokomea Village, West Poleang Subdistrict. The number of voters who turned up was 247, matching the number of ballots used as well as the count of valid and invalid votes. There was also no discussion of any objections or findings by the subdistrict election supervisory committee (Panwascam) regarding this claim.

The KPU also refuted the Petitioner’s claim of vote discrepancy between Gerindra (Great Movement Party), PDI-P, Hanura (People’s Conscience Party), and PAN (National Mandate Party) at TPS 002 in West Boepinang Village, stating no discrepancy between the C-Result forms from the polling station working committee (KPPS) and the C-Result forms or C-Copies. The KPU noted that any vote discrepancies were resolved during the subdistrict-level plenary recapitulation, with adjustments confirmed by party witnesses, Panwascam, and the subdistrict election committee (PPK).

The KPU confirmed that PDI-P received 1,971 votes in Bombana Regency 3 and argued that PDI-P’s request for a revote was baseless, suggesting it could potentially decrease their vote count.

No Reports

Bawaslu reported no evidence or reports supporting the Petitioner’s claims, confirming that no voter voted more than once and there were no objections from party witnesses during the voting and counting at TPS 001 in Ranokomea Village, West Poleang Subdistrict.

Bawaslu of Southeast Sulawesi Province reported no objections, incidents, or violations at TPS 002 in Pallimae Village, Poleang Subdistrict. However, a clerical error on the C-Result form at TPS 002 in West Boepinang Village was corrected by the KPPS, and party witnesses signed the corrected C-Result copies.

On another note, the Relevant Party in this case is Gerindra. Gerindra, through its legal counsel, essentially requested the Court to reject PDI-P’s petition.

In the petitum, PDI-P as the Petitioner asks the Court to order the KPU to conduct a revote in Bombana Regency 3, including Poleang and Tontonunu Subdistricts. The specified locations for the revote include TPS 01 in Ranokomea Village, West Poleang Subdistrict; TPS 01 in Watu Melomba Village, Tontonunu Subdistrict; TPS 02 in Pallimae Village, Poleang Subdistrict; and TPS 02 in West Boepinang Village, Poleang Subdistrict.
