KPU: Petitioner and KPU’s Data in South Papua Align

JAKARTA (MKRI) – The Constitutional Court (MK) held another hearing on the 2024 Election Results Dispute (PHPU) for members of the DPR (House of Representatives), Provincial DPRD (the Regional Legislative Council), DPRK (the Regency/City Legislative Council) in South Papua Province on Monday (13/5/2024) in the Court Plenary Hearing Room. The petition was filed by the Democratic Party regarding the allocation of seats for members of the DPR, Provincial/DPRP DPRD, the Regency/City Legislative Council (DPRK) in South Papua Province, specifically in Electoral District (Dapil) Asmat 3.

Yusuf Agung Purnama, representing the Respondent for Case No. 267-01-01-35/PHPU.DPR-DPRD-XXII/2024, stated that upon reviewing the petitioner's data and comparing it with the respondent's data from the Dapil Asmat 3 District, no discrepancies were found between the District and Regency-level data as alleged by the petitioner in their petition.

"During the Asmat Regency-level Recapitulation Plenary session on March 9, 2024, for the DPRD Dapil Asmat 3, objections were raised by the Indonesian Democratic Party of Struggle (PDIP) as written in the Special Incident/Objection Witness Form," explained Yusuf.

Yusuf further added that during the Provincial-level Recapitulation Plenary hearing in South Papua, the Asmat Regency KPU (General Election Commission) reported that there were still unresolved objections from the Indonesian Democratic Party of Struggle (PDIP) as per the Special Incident/Objection Form. Based on this form, the PDIP witness objected to the initial Regency Plan and brought the dispute to the Provincial Election Supervisory Body (Bawaslu).

Upon recommendation from the South Papua Provincial Bawaslu, the Asmat Regency KPU conducted a Correction Recapitulation Plan on Sunday, March 17, 2024, at the South Papua Provincial Assembly Hall. In this plan, the data from the District and Regency levels were aligned once again with the vote acquisition results as shown in the table above. This session was attended and signed by political party witnesses and Asmat Regency KPU Commissioners.

Based on the aforementioned details and the lack of evidence supporting the petitioner's claims, Yusuf requested that Case No. 267-01-01-35/PHPU.DPR.DPRD-XX|I/2024 reject all of the petitioner's claims.

Meanwhile, through Marman, Bawaslu clarified the petitioner's claims regarding the receipt of a letter from the Asmat Regency KPU inviting Bawaslu to attend a meeting for the Correction of Recapitulation Data on March 17, 2024, based on the recommendation.

"Regarding the implementation of the Correction of Recapitulation Data on March 17, 2024, in Asmat Regency, attended by election participants' witnesses, the data alignment of District-level results with the DPRD Regency from the Districts within the Asmat Electoral District was conducted," he emphasized.

Furthermore, he continued, the Asmat Regency KPU finalized the results without giving political party witnesses and the Asmat Regency Bawaslu the opportunity to raise objections, only stating that objections could be submitted through the Special Incident Form.
