JAKARTA (MKRI) — The General Elections Commission (KPU) denied allegation of vote inflation for NasDem (National Democratic Party) affecting Garuda’s (Indonesia Guard of Change Party) vote count. This statement was made by KPU’s legal counsel Bakhtiar Panji Taufiq Ulung at a follow-up hearing for the 2024 election results dispute in the Constitutional Court (MK) on Wednesday, May 8, 2024. The case No. 229-01-02-12/PHPU.DPR-DPRD-XXII/2024 was filed by Gerindra, who claimed vote inflation had occurred in 51 subdistricts across Majalengka and Subang Regencies.
“The Petitioner’s claims number (3) and (4) that vote inflation occurred in 51 subdistricts in Majalengka and Subang Regency are unproven, as the tiered recapitulation process for DPR (House of Representative) election in West Java electoral district IX showed no specific objections from Gerindra (Petitioner),” explained Bakhtiar.
The Petitioner failed to detail the alleged violation as outlined under Article 372 paragraph (2) of Law No. 7 of 2017. Consequently, these claims should be dismissed.

Election Process in Line with Regulations
Meanwhile, the West Java Provincial Bawaslu (Elections Supervisory Body) has carried out its duty to prevent election violations by issuing a directive to the West Java Provincial KPU to conduct the election process according to applicable regulations.
“The Majalengka Regency Bawaslu has performed preventive measure by issuing an instruction letter No. 70/PM.00.02/K.JB-12/02/2024 dated February 16, 2024 to all subdistrict Panwaslu (Election Supervisory Committee) in Majalengka, which mandates that the PPK (Subdistrict Election Supervisory Committee) recapitulates votes after receiving sealed ballot boxes from all polling stations (TPS) via the PPS (Polling Committee) in their area and ensures that the plenary recapitulation meetings are attended by witnesses, subdistrict Panwaslu, PPS, and PPS secretariat,” legal counsel Muamarulloh clarified.
Thus, based on the supervision report on direct supervision of the provincial-level open plenary meeting for recapitulation of vote count results and certification of the 2024 general election results of West Java Province, there were supervision notes for Majalengka Regency indicating errors in data entry on male and female categories, and a review of the data will also be provided to Bawaslu.
“Based on the supervision report No. 049/LHP/PM.01.01/03/2024 dated March 10, 2024, which primarily concerns direct supervision of the provincial-level open plenary meeting for recapitulation of vote count results and certification of the 2024 general election results of West Java Province, there were supervision notes for Subang Regency indicating that at the plenary meeting at the district level by Pusaka Jaya PPK there were corrections due to some villages not being recapitulated, resulting in a column shift during data entry,” Muamarulloh reported.
Petitioner’s Claims Unproven
NasDem (Relevant Party), represented by Husni Thamrin, denied the claim of a reduction of 213,869 votes for the Petitioner in West Java IX, noting that the official count in KPU Decree No. 360 of 2024 still lists the Petitioner’s votes as 320,803.
“In the petition, the Petitioner does not elaborate in which polling stations the Relevant Party’s votes were inflated in 51 subdistricts in Majalengka and Subang Regencies, nor does it provide comparative data on inflation of NasDem’s votes, so the Petitioner’s claim of 11,200 inflated votes in the subject matter is baseless and must be dismissed by the Court,” Husni asserted.
The Petitioner’s claim of vote inflation for NasDem and vote reduction for Gerindra in 53 subdistricts in Majalengka and Subang are unfounded. A comparison of the DPRD election D-Results forms for West Java Province in electoral district IX and those for Majalengka and Subang Regencies shows no discrepancies in the vote counts for the two parties.
