KPU Answers Gerindra Candidates’ Dispute for Cianjur 3

JAKARTA (MKRI) — The General Elections Commission (KPU) denied the argument that there were additional and reduced votes among fellow legislative candidates of the Great Movement Party (Gerindra) in the election of Cianjur Regency DPRD (Regional Legislative Council) for Election District (Dapil) 3. This was conveyed by the KPU as the Respondent in responding to the 2024 general election results dispute (PHPU) application at the Constitutional Court (MK) filed by Gerindra candidate Hendry Juanda.

"The Respondent denies all arguments in the Petitioner's petition a quo, except those that are expressly true by the Respondent," said the Petitioner’s legal counsel Ahmad Karomi Akbar in the panel courtroom of the Court, on Wednesday, May 8, 2024. Case No. 55-02-02-12/PHPU.DPR-DPRD-XXII/2024 was heard by Chief Justice Suhartoyo and Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah in Panel 1.

KPU said that the correct vote count for Hendry Juanda was 5,499 votes and Gugun Gunawan was 5,539 votes. The alleged addition or subtraction of votes at polling station (TPS) 7, 13, 14, and 18 Sukaresmi Village, and TPS 4 Kawungluwuk Village originated from a review by KPU due to objections from Gerindra witnesses attended by witnesses and Bawaslu (Elections Supervisory Body).

According to the KPU, the review of vote acquisition was an agreement agreed by all witnesses including the election supervisory committees (Panwas) because there were writing errors made by the polling station working committee (KPPS). There were discrepancies between the C-results and C-copies owned by witnesses and the election supervisory committees.

In addition, at the recapitulation at the Sukaresmi subdistrict level, a plenary was held to open ballot boxes in two villages, namely Mekarsari and Kubang as a follow-up to the recommendation from the subdistrict election supervisory committees to prove invalid ballots because there were differences. It turned out that after opening the boxes, there were invalid ballots in the ballot envelopes.

In his petitum, the Petitioner requested that the Court order the KPU to conduct a revote (PSU) for candidates for DPRD Cianjur Regency 3 at TPS 12, 13, 14, 15, and 16 Mentengsari Village, Cikalongkulon Subdistrict, Cianjur Regency, West Java Province. He requested that the Court cancel KPU Decree No. 360 of 2024 on the certification of the 2024 legislative election results of the DPR (House of Representatives), DPD (Regional Representatives Council), and Provincial and Regency/City DPRD announced nationwide on March 20, 2024 at 22:19 WIB along the Cianjur 3 for the filling of candidates for Cianjur Regency DPRD members. He also requested that the Court to determine the correct vote acquisition results for the filling of candidates for DPRD Cianjur 3, namely Hendry Juanda 5,514 votes plus the revote results and Gugun Gunawan 5,506 votes plus the revote results.
