JAKARTA (MKRI) — Hendry Juanda, a Great Movement Party (Gerindra) legislative candidate has filed a petition over the regarding to the 2024 DPRD (Regional Legislative Council) election dispute (PHPU) to the Constitutional Court (MK) for Cianjur Regency, West Java Province. He disputes the vote acquisition with another Gerindra candidate for the Cianjur Regency DPRD electoral district 3, Gugun Gunawan.

“The main point of our petition is Gerindra Party candidate number 1 Hendry Juanda, LLB against candidate number 4 Drs. H. Gugun Gunawan for the Cianjur Regency DPRD in the electoral district of Cianjur 3,” said the Petitioner’s legal counsel Juliana Panjaitan in the panel courtroom in the Court’s second building in Central Jakarta on Tuesday, April 30, 2024.

The Petitioner believes he should have received 5,514 votes, while the General Elections Commission (KPU) certified 5,499 votes. He also claimed that Gugun Gunawan only had 5,506 votes, not 5,539 votes as determined by the KPU.

The Petitioners claimed to be disadvantaged because of the reduction of his votes by the KPU. The addition of votes for Gugun Gunawan for Cianjur Regency 3 DPRD occurred at polling station (TPS) 12, 13, 14, 15, and 16 of Mentengsari Village, Cikalongkulon Subdistrict. The ballots were cast outside the specified time by Mentengsari village chief Somantri and KPPS (polling station working committee) personnel.

The Petitioner argues that the opening of ballot boxes was not conducted properly at the polling stations mentioned. He believes Article 327 paragraph (2) letter a of Law No. 7 of 2017 on General Elections (Election Law) has been violated.

In his petitum, the Petitioner asks the Court to order the KPU to conduct a revote for DPRD Cianjur Regency 3 at TPS 12, 13, 14, 15, and 16 of Mentengsari Village, Cikalongkulon Subdistrict, Cianjur Regency, West Java Province. He also requests the Court to annul KPU Decree No. 360 of 2024 concerning the certification of the 2024 legislative election results of the DPR (House of Representatives), DPD (Regional Representatives Council), and Provincial and Regency/City DPRD (Regional Legislative Council) announced nationally on March 20, 2024 especially for Cianjur Regency DPRD. He also requests the Court to certify his version of the correct vote acquisition for DPRD Cianjur Regency 3: 5,514 votes for Hendry Juanda and 5,506 votes for Gugun Gunawan, plus the results of the revote for both.

The Case No. 55-02-02-12/PHPU.DPR-DPRD-XXII/2024  was heard by panel 1 presided over by Chief Justice Suhartoyo (panel chair) and Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah.
