KPU: No Vote Transfer in West Java 6

JAKARTA (MKRI) – KPU as the respondent stressed that there was no transfer, shift, or reduction of the Petitioner’s votes in favor of the Golkar Party and the Prosperous Justice Party (PKS). Khairil Amin conveyed this as the legal counsel for the National Mandate Party (PAN), which became Petitioner of Case Number 92-01-12-12/PHPU.DPR-DPRD-XXII/2024. The second session of the General Election Results Dispute (PHPU) case for the election of candidates for DPR members in West Java Election District VI was held by the Constitutional Court on Wednesday (8/5/2024) in the Plenary courtroom of the Constitutional Court. The session was presided over by Chief Justice Suhartoyo with Constitutional Justice Daniel Yusmic P. Foekh and Justice M. Guntur Hamzah, the agenda was to listen to the Respondent’s Answer, the statement of the Related Parties, and the statement of Bawaslu.

Khairil Stressed that there is a vote reduction for the petitioner, and also an increase of other parties which are The Party of Functional Groups (Golkar) and Prosperous Justice Party (PKS) in several polling stations spread across several villages in 6 Subdistrict at Bekasi City is untrue and not supported by legal facts. 

“The results of the recapitulation of the election vote at the East Bekasi PPK level were accepted by the witnesses of the election participants witnessed by the Bekasi City Bawaslu, and determined by the Bekasi City KPU.  The whole process of recapitulating the vote count mentioned in number one was conducted in the presence of witnesses from election participants and North Bekasi subdistrict election supervisory committee (Panwascam),” he explained.

He said that as the organizer of the general election at the sub-district level, the South Bekasi District Election Committee (PPK) had conducted the votes recapitulation of the 2024 General Election at the sub-district level from February 17 to March 9, 2024.

Then, Khairil also said, that the recapitulation of votes at the sub-district level in South Bekasi for the Presidential Election, West Java Provincial Regional Representatives Council (DPD), DPR, DPRD Regency legislative candidate went well and was attended by witnesses of election participants and election supervisors.  Meanwhile, the process of recapitulating the vote count has been under the provisions as stipulated in Articles 18 paragraph (4) of KPU Regulation Number 5 of 2024 concerning the vote counting recapitulation results and determination of general election results.

Petition Unclear

Furthermore, the PKS Party, represented by Joko Fitrian Prabowo as a related party, stated that there was a lack of clarity on the number of votes allegedly transferred from the petitioner, which totaled 18,124 votes, to the Golkar Party, which totaled 8,179 votes, and to PKS, which totaled 10,045 votes. In sum, the votes that went to the Golkar Party and PKS were 18,224 votes, but the petitioner claimed 18,124 votes, resulting in a difference of 100 votes. Thus, it is unclear how many votes the petitioner claims went from the petitioner to the Golkar Party and the PKS.

The number of votes that did not move was used by the petitioner as a basis for rejecting the results of the vote count at the subdistrict, city, provincial, and central levels in West Java Electoral District VI. However, in his petitum, there is a difference of 100 votes in the number of valid votes in West Java Electoral District VI. The petitioner argued that the total number of votes obtained by the petitioner should have been 2,418,493, but based on the table submitted by the petitioner in point 4, it was 2,418,393, so there was a difference of less than 100 votes.

The Respondent argues that the transfer of votes for any reason should not reduce the total number of valid votes. Because it means that it has eliminated the voting rights of the citizens as voters, which is a constitutional right of Indonesian citizens that should not be eliminated.

No Objections

Meanwhile, in Bawaslu's statement explained by Usep Agus Zawari, it was stated that there were no findings and reports in the Bekasi City Bawaslu and the West Java Provincial Bawaslu related to the subject matter of the petition requested by the Petitioner.

"At the city level recapitulation, Bawaslu Bekasi City supervised the National Mandate Party (PAN), who did not sign the minutes of the recapitulation of the acquisition of votes for members of the DPR RI West Java VI Dapil Bekasi City," said Usep.
