JAKARTA (MKRI) — The Constitutional Court (MK) held the preliminary hearing for the dispute over the results of the 2024 election of the House of Representatives (DPR), Provincial and Regency/City Regional Legislative Council (DPRD) of the electoral district (dapil) of West Java VI on Tuesday, April 30, 2024 in the plenary courtroom. The case No. 92-01-12-12/PHPU.DPR-DPRD-XXII/2024 was petitioned by the National Mandate Party (PAN). The hearing was presided over by Chief Justice Suhartoyo (panel chair) and Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah.
At the hearing, the Petitioner legal counsel Heru Widodo said the difference in vote counts has reduced the Petitioner’s votes at 588 polling stations spread across 11 villages in 6 subdistricts in Bekasi City and affected votes for the Party of Functional Groups (Golkar) and the Prosperous Justice Party (PKS).
“The significant vote reduction has resulted in the Petitioner losing the sixth seat in DPR of West Java VI. The Petitioner has submitted objections on the Bekasi City recapitulation results at the city, provincial, and national levels,” Heru explained.
Then, he continued, during the recapitulation at the subdistrict level in Bekasi City, the Petitioner’s witnesses did not sign the minutes of recapitulation in 6 subdistricts. In addition, the Petitioner also submitted an objection to the recapitulation of vote count results by the Bekasi City General Elections Commission (KPU) to the Bekasi City Bawaslu (Elections Supervisory Body) with a letter dated March 13, which was received by Bawaslu on March 15. Still, the Bekasi City Bawaslu did not follow up or respond to the objection.
“Objections were then conveyed at the recapitulation at the provincial and national levels by filling out a special incident form and/or witness objection by asking for a recount. This is due to a very significant difference between the C copy form and the final recapitulation results with the subdistrict D-result form,” Heru explained.
For this reason, in its petitum, the Petitioner asks the Court to cancel the KPU Decree No. 360 of 2024 as it pertains to the acquisition of valid votes and the ranking of candidates’ valid votes for DPR in West Java VI election district for Golkar, PKS, and PAN in Aren Jaya and Durenjaya Villages of East Bekasi Subdistrict of Bekasi City; in Kotabaru and Kranji Villages of West Bekasi Subdistrict; in Harapan Baru and Perwira Villages of North Bekasi Subdistrict; in Jakamulya Village of South Bekasi District; in Bantargebang, Cikiwul, and Ciketing Udik Villages of Bantargebang Subdistrict; and in Jatiluhur Village of Jatiasih Subdistrict.
