Court Asked to Dismiss Depok City NasDem DPD Chair’s Petition

JAKARTA (MKRI) — The Constitutional Court held a follow-up hearing for the 2024 election results dispute of the DPR (House of Representatives), Provincial and Regency/City DPRD (Regional Legislative Council) for the electoral district of Depok City on Wednesday, May 8, 2024 in the plenary courtroom. The hearing for case No 142-02-0-12/PHPU.DPR-DPRD-XXII/2024, filed by Hardiono and Teguh Poedji Prasetyo, was presided over by Chief Justice Suhartoyo with Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah.

The General Elections Commission (KPU) legal counsel Ali Nurdin stated that the case was filed by two individuals, chairperson of Depok City regional executive board (DPD) of NasDem Hardiono and director of witnesses of NasDem’s Depok City DPD Teguh Poedji Prasetyo. Both are not political parties in the 2024 Election.

“The Petitioners do not represent a Political Party participating in the 2024 Election, nor are they individual candidates for DPR and/or DPRD from a political party that has received written approval from the party’s chairman and secretary-general,” said Ali. Therefore, the respondent requested that the Court not accept the application.

In its written response, the KPU of Depok City held a city-level plenary recapitulation meeting on March 4, 2024. During this meeting, a Prosperous Justice Party (PKS) witness requested a re-examination in the Sawangan Subdistrict due to data discrepancies that negatively affected the party’s legislative election results.

Bawaslu’s Statement

Bawaslu, through Nuryamah, advised the Depok City KPU to have the polling committee (PPS)  via subdistrict election committee (PPK) to immediately publicize the Model C. Results Copy forms of its villages. Bawaslu supervised the Open Plenary Meeting for Recapitulation of Vote Count Results and Certification of the Simultaneous Election Results for 2024 on Monday, March 4, 2024.

During the meeting, when the Sawangan PPK presented the Recapitulation of Vote Count Results for the DPR at the Sawangan Subdistrict level, a witness from PKS objected due to discrepancies between the D.Results agreed upon in the Subdistrict Level Recapitulation Meeting and the D.Results presented by the PPK Sawangan at the City Level Plenary Meeting.

Following this incident, the Depok City Bawaslu directed the Depok City KPU to re-examine the vote count recapitulation at the Sawangan Subdistrict level, as agreed by participants of the Open Plenary Meeting for Recapitulation of Vote Count Results at the City Level of Depok to conduct the re-examination
